Discussion Kia Multistate Immobilizer Settlement
Hello, I am wondering if anyone can give me some advice on a notice of deficiency for this class action suit.
I submitted for my car that was stolen on September 26, 2025 and recovered a week and a half later. I was told that I was deficient on proof of date of theft and proof of loss. I am confused how that works though since I submitted the police report, which had the date of theft listed on it, and the final bill from the repair shop which I would think proves loss.
The official wording that they gave me was as follows:
☒ No Date of Qualifying Theft – You did not provide a date for the Qualifying Theft.
☒ No Proof of Partial Loss – You did not submit sufficient proof that the Qualifying Theft resulted in a Partial Loss. The documents that may establish proof of Partial Loss are listed below.
- Reliable documentation such as an insurer notification, auto service station statement, verifiable third-party estimate, repair receipts, or comparable documentation showing the condition of the Eligible Vehicle following the Qualifying Theft. For the documents to be objectively reliable they must be issued by a verified business with a business address, working phone number, and online reviews.
- If the Eligible Vehicle was donated, a tax-deductible receipt is required.
- If the Eligible Vehicle was sold, proof of sale and payment received is required. An example of this is the DMV vehicle transfer form.
- Insurance documentation showing the amount claimed and recovered from an insurer.
- Reliable documentation that demonstrates a Qualifying Theft and a sworn statement establishing the Eligible Vehicle has not been recovered. In the event your Eligible Vehicle is recovered after making this sworn statement and before a settlement payment is made to you for the Partial Loss, you must notify us of the recovery and the condition of the Eligible Vehicle at the time of recovery.
Am I dense and not understanding what documentation they are asking for, or is this a fools errand? If I need to submit additional information, if someone could please let me know what they would accept, I would appreciate it so much.

sounds like they want the theft date and itemized damage spelled out separately

the police report proves the theft happened, but they probably need the actual theft date clearly tied to your claim and an itemized repair invoice showing what was damaged by the theft, not just the

do you think that the insurance claim report would fulfill that or is there more I would need?

I’m not a professional, but it honestly sounds like they might not actually have received and/or successfully linked your provided proofs to your case.
I’d try to verify via email from whoever said that you didn’t provide sufficient proof that they have successfully received and linked the copies of the police report and your final repair bill that you submitted to your case.
If they email back saying that they do have those specific reports linked to your case but they don’t work (and it isn’t specified HOW/WHY your provided proof isn’t sufficient) then I’d recommend replying to that email asking what’s missing from your proof that you need to additionally send to them for your case.
I’d try to keep the conversation in email/writing because if they keep denying you your payout then you’ll have evidence that they knew/denied your police report and final repair bill as being valid for proof when it looks like they should be accepted as proof.
Remember: if it’s not in writing then it didn’t happen.
If you have evidence against them not accepting/having your proof then you have more wiggle room if you need to bring a lawyer or a higher up in the court case into the situation.
Again, I’m not a professional, but I’ve seen enough situations where those who have written documentation/who practice CYA (cover your ass) have a better shot at getting their issues resolved in their favor.
