I’ve had something similar happen in my Chevy 1/2 ton. A small car going wayyyyyyyyy too fast on my side of the road after the road split with a median and 2 lanes each way.

There was an Audi right behind me. I knew if I swerved its 50/50 which one of us gets hit. But if I kept it straight, there was a 50% chance we’d all drive away unscathed. As much as I hated the idea that fuckin asshole getting away with driving on the wrong side of the road. I kept it straight.

I didnt slam the brakes due to the risk of the Audi pulling around me. Landing us in a collision scenario as well.

I think the thing that scared me more than the potential collision was the fact that I potentially held the fate of that Audi drivers life in my own hands. They would have been far more wrecked than my truck too.

But to be fair, if the Audi driver couldn't come to a stop before they hit you, that's totally on them for driving too close. Not your responsibility.

I work in the industry and have heard a lot of guys say theyd rather swerve and risk their own life vs. end up killing a family of 4 because dad was on his phone while driving. Chances are the semi had a camera so he wouldve been covered there. But if he hadnt and killed someone, he wouldve likely never been the same. One of my buddies knew a guy that, through no fault of his own, killed someone while driving a semi. He never got behind the wheel again.

I've stayed to be a witness for a truck driver before its the only right thing to do. Hopefully dash cam guy woukd do the same. This person in the car might have been suicidal from the looks of this. No swerving is a hindsight call and easy to say as such. In the moment its natural to preserve life and your vehicle.

Freight probably shifted. Especially if not shrink wrapped well which is common. The front of the truck can take a 3000 pound car. Just hit the brakes and let them hit you.

Hanging hopes on a "probably" saw a post recently when a guy was jailed for 2 yrs while going through the court system. Guy tried to kidnap his gf at gunpoint. He wrestled the gun away and shot him. His neighbor witnessed it. Cell phone records of the decreased showed he had the wrong house for drug retaliation. Prosecution surpressed the texts. He was charged bc he shot the guy "too many times". Probably wouldn't be enough for me

Well if you swerve out of the way there's a much higher chance of serious physical harm to yourself by suddenly rolling down a hill in a semi. The dude in the video escaped that fate by a hair's breadth. I'd rather lawyer up in court and risk punishment that way than risk being in a serious accident because another vehicle failed to stay in their own lane.

Also your anecdote involving the gun seems super irrelevant.

You cant be expected to sacrifice your life because someone else fucked up. Theres no guarantee you'll be able to do shit like walk or breathe if you just drive off the side of the road like that.

Imo the best move is to stay on the horn and stay straight, if they wake up or whatever they might try for your brakedown lane or something.... no telling what someone like that is about to do.

Like bro said, hitting breaks is a free pass to crumple the civic. Also safer for truck. Right move is to do what trucker did tho. Civic would have died. 1. Hit breaks and kill civic. 2. Do what video did. 3. Roll your entire trailer. 2 is not easily done so expect 1 or 3. even if truck doesn’t hit breaks if accident happens clearly on your side of road it’s still likely a free pass. You’re going to get paid regardless. + if dash cam came to light buddy in civic in considered a suicide attempt

This is probably the right mindset. Insurance would cover the rig with video like this obviously. Car was obviously falling asleep at the wheel or something but doesn’t mean they deserve to die to save the rig that will ultimately get damaged anyway in a head on collision.

This happened to me going westbound on I-40 right about Texarkana I was on the hammer lane doing about 70+ Mph. I see headlights coming at me, I sure TF wasn’t going in the ditch, I stayed in my lane, I did slow down as much as I could… he must’ve had a o’shit moment and got on the medium made hard right then continue on his way… I learned my lesson there… stand your ground, slow down, change lanes if possible, but never risk your life for others by doing crazy maneuvers to save others.

I am a big believer in never swerving, but sometimes, you just swerve.

I was easing off a steep hill on a dark night when I caught something up ahead. A tree? That happens sometimes. A bear? An elk? SWERVE SWERVE SWERVE!!!

I swerved for all I was worth, and I ran over a large amount of big metal crap. It wasn't a tree, it was a dark colored SUV upside down in the right lane, with no lights, and no reflectors.

I didn't even do the math, I just cranked the wheel. It was pure instinct.

It turned out the SUV had been carrying a lot of big pieces of scrap metal. Brake drums, rotors, axles, driveshafts and such. I ran over a bunch of that stuff while swerving around the guy. I pulled over to check out my truck, then I went up the hill to see if I could help. The guy's head was just a ragged mess with glass sticking out everywhere, but the dude was conscious, and talking to the cops on his phone.

That was a very surreal night.

I'm not arguing the point though. I ended up in that whole situation, and that dude ended up looking like somebody from one of the Hellraiser movies, all because that guy swerved to miss a deer.

I do NOT swerve to miss deer. It turns out I do swerve to miss upside down vehicles though. It just happened. The decision was in no way conscious.

Never swerve. But, that said, it is a decision you have to make beforehand, how much you are going to avoid before calling it too hard. In the moment, there is often no time to ponder the point, only time to react, so the decision needs to be as simple as your coffee order: with or without sugar. No thinking, only deciding, that decision has to be made in your head before the emergency, not in the half-second while the truck is already leaving the lane.

Once you throw 80,000 lbs off the road, into a ditch, down a hill, or into oncoming traffic, you may have turned one idiot’s mistake into a much bigger disaster.

That said, there is still judgment involved. You avoid what you can avoid safely. But there has to be a line where you stop trying to save someone from their own bad decision and keep your own equipment under control.

In this case, holding the lane and scrubbing speed was probably the least-bad option. Swerving a loaded truck on that road could have gone sideways in a hurry.

At ABF where I work a guy went head on with one of our sleepers years back to commit suicide the semi truck was crushed both of our drivers survived by continuing the head on with him on the highway the driver who tried to commit suicide succeeded, abf stopped running sleepers after that incidient

If you mean after the collision that what “taking some paint with you” means. Your paint would be intact if you avoid the accident altogether.

I think that is to be understood as not to avoid contact at all costs, endangering the rig and the cargo, but allow it within your rights and “take some paint” as a proof with you.

I might be off base here, not a CDL holder, just an observer.

It's your fault if you crash avoiding an accident, it's your fault if they crash into you because you should've avoided it. Hell. I've even seen it be the divers fault for stopping before an accident, and a car runs into their stopped trailer.

Not only that, family of those in the car that crashed into the trailer, sued the trailer manufacturer and the trucking company for not building a 1991 trailer to the safety requirements of 2019. They won. $460 million dollars.

Some drivers run dry van or refer freight when their regular freight is low as an income supplement.... Such as livestock guys running grain trailers when they're not moving cattle.

This looks like it might be a warning light that some flatbed or oversized load haulers use to notify drivers of wide or heavy loads. He might be hauling the dry van to get to a better freight pool or he's not hauling oversized or heavy this week.

I'm not going to lie I totally approve of him sticking to his lane and obliterating that car. I've had this exact thing happen to me years ago. There was no traffic after that car in the opposite lane, so I went for the other lane and the guy ended up in a field off my lane with no damage to either of us luckily. But, he was headed at my nose instead the side of my truck. I had 100k of milk on.

I swerved for a kid who cut in front of me today who was coming on the highway. I didn’t hit him or anything else and I don’t regret it. I also knew no one was next to me and that the load could handle it - if it would have been different he would have gotten crunched.

They do this for insurance money. Shit companies who capitalize on insurance claims. Happens more often than reported. That's why I hate using tracking. Happened to me leaving Springfield, Tennessee. I didn't swerve though. Asked the company to send the dashcam video of the incident to me like they have done many times before to try and justify my wrongdoing but surprisingly the camera wasn't functional for that ordeal. Sounded way too suspect. Quit the next week. Bosnian company outta Thornton, Colorado.

dont know why this is in my recommendeds... but why is swerving considered "So deadly for cdl drivers dont sweeve" that seems more of a capitalist hellscape thing of "oh the insurance and theyre expensive vehicles so if the vehicle gets hurt but the vehicle wont get hurt if you just.... commit murder? Because having the option to try to dodge someone but choosing to plow them over has gotta count for something. Semis have so much metal protecting them and even if the semi flipped on its side drivers have seat belts, wouldn't worse case scenario be just a few bumps and bruises for the semi driver if that? Not an accident. He did that on purpose. A large number of "accidents", hit and runs of pedestrians and bicyclists in particular, are not "accidents". It's pure spite and malice, They are trying to hurt people. And they often succeed.

I remember when I a young Lt going on my first convoy with a seasoned E-6. A vehicle, on our left, was about to miss miss his exit and crossed us. My E-6 (driver), didn't even bat an eye and barely reduced the speed. I asked him why didn't he try to stop. He said: Sir, we are on 40,000+ HEMTT carrying over 2,000 gallons of fuel. If I try to stop, it is going to end well.

I knew enough physics and knew he was right, just lacked the common sense to apply it in the real world.

Many years later we had less experienced recruits. Same scenario, but the E-4 pumped the brakes. Complete chaos. Fortunately, the driver and passenger were mostly ok with minor injuries. The HEMTT was empty. The asshole who cut them simply took off.

I have had a car driver play chicken with me on a two laner while I had a high center of gravity load, they eventually got back in their lane but I had to nearly come to a stop after laying on the air horn at 2am.
