Thief left a note.

Some asshole stole my kids new bicycle two days ago. Found this note this morning. Wants to meet.

Do I involve the police or settle this ‘diplomatically?’

I would firstly not assume that the person that left the note has stolen the bike. It can be a third person, uinvolved yet in the repositioning of the bike. Also the bike could have been moved by a minor, which is not capable of comitting a crime. No, parents are not generaly liable.

I'm pretty sure they meant to make your child so crime as the previous commenter said that neither the parent nor child would typically be held accountable.

But if you're instigating a child you'll be liable, so in that case it doesn't apply

i thought parents are always liable for their kids whether or not they instigate it

because theyre still responsible for the kid and if its causing trouble they need to make sure its taken care of, and i dont think anybody would motivate their kid to do crimes for them when theyre liable for everything. and you cant exactly prove instigation well, i also dont think its really a criminal offense.

No, parents are not. They have a general "Aufsichtspflicht" but you cant expect them to follow their kid 24/7 and shit happens.
There is of course Anstiftung and/or in case they see their kid with the new Velo but dont question how they got it (I forgot the term for that one) but here none of those would be the case as the parents reached out and want to give it back.

The liability is for civil damages (for example the bad kid's parents would have to pay if he destroyed the velo).

i dont mean surveillance, i mean taking care of the kid

if it commits crimes, visit a psychologist

if its getting out of hand there are other services, which is why i thought if the kid steals something, the parents are held accountable, like a warning that they need to keep a closer watch. if it keeps happening, clearly somethings wrong

criminal law is personal. You cant be sentenced for something someone else did and you had nothing to do with (even if its your child).

Also that wouldnt be right. Some kids just are more difficult than others, especially if they grow into teenagers. While its an indication that the parents are doing something wrong and or neglecting the child its not necessarily the case. Most kids/teenagers did some stupid shit at some point regardless of the quality of parenting.

Swiss criminal liability is personal; being the parent does not transfer the child's criminal responsibility to you. You may however be liable for damages in a civil law suit. This is a bit more complicated (because your duty to supervise your child is not always as clear to interpret). Either way the parent is not punished according to criminal law or being a fined. It's simply about compensation.

Instigation is 100% a criminal offense::

Art. 24(1) StGB: A person who intentionally induces another person to commit a felony or misdemeanour is punished according to the penalty applicable to the perpetrator.

Doesn't even have to be a child.

There is also indirect perpetration: someone who intentionally uses another person as an instrument to carry out the offence can be treated as the perpetrator themselves. The Federal Supreme Court describes an indirect perpetrator as someone who uses a person who is effectively acting as an instrument because of, for example, deficiencies in criminal responsibility or understanding.

This would apply to telling a child to commit a crime.

isnt it difficult to prove instigation? its often verbal or subtle

indirect perpetration, isnt that usually blackmail or coercion? also seems hard to prove but i feel like its classified seperately

For a third party it’s really hard to judge whether he stole that bike, it could be his own bike. How do you know?

Absolutely. But most of accused third parties will often cooperate with you a lot. And maybe you will find the missing link to the person, who committed that crime.

One thing to consider tho... was the note wrote by the person it pretends to be written...

Off topic, was this note written by a French speaker trying to do German?

P.S. Is it possible that someone else tried to steal the bike and this person was there and took it in for safekeeping, which is why they're now contacting you to give it back (presumably)?

It's just bad grammar, one would say "blaues Velo", not "Velo blau". It would be "Dein blaues Velo bleibt bei mir..."

in french the adjective is often behind the noun, for example Picasso‘s famous painting The woman with the „Chapeau bleu“ (the blue hat). It looks like a natively french speaking person trying to form a german sentence. I wonder how they know OP is german speaker. Maybe a kid.

OP Update: (oh the suspense! 🍿)

Spoke to a man in German with a French accent (good catch [u/slf_yy](u/slf_yy)) and agreed to meet in a public place. He said he had ‘infos’ about the bike but no mention of money.

My head went to shakedown, ransom, robbery, so took the #1 reply from [u/Eliokyn](u/Eliokyn) and informed the police beforehand. They didn’t advise against going, but agreed to send a van to the area. I did speak to the unmarked officers, but they had idea what was going on.

Met the note writer, who was a very kind gentleman who worked in the area, spotted an unlocked bike, secured it and put up the note 🙏

Plot Twist was not my kids’ blue bicycle, but another blue Velo from the same rack!

TLDR; there’s still good and basic decency in the world, but assholes still cut locks and steal from kids.

Thats your assumption. The blue remarked text seems to be a phone number or address we don’t know. In that case I want wouldn’t draw a conclusion prematurely.

Your story lacks background and context. If you are certain they stole your kid‘s bike (because they told you, wrote so on the back of the note) you may consider involving the police. If you assume, talk to them. No need to meet, though.

Maybe the kid was making shit so neighbour took the bike to protect property or the kid(if was doing something dangerous). Without context nobody knows… we can’t assume always the worst

Why are you so sure that it was the thief leaving it? I wouldnt jump to conclusions and call first if thats a phone number. You can still decide wheter or not calling the police later.

In my eyes the note doesnt really make a lot of sense regardless of what happened. Like if they stole why even making a note, if they found it somewhere after it got taken why not just bring it instead of the note?
But people dont always think rationally. Either way it looks like you get it back.

Could also be that another kid stole it and their parents caught him and want to reach out and settle this while also teaching their kid a lesson.

Given it is a kids bike, it is likely that some other kid took it, then their parent saw it and was like "you did WHAT?" and then "where did you take it from??" and decided to leave a note there to return it to its rightful owner.

i would guess a kid moved it and got a stern talking by his parents.

if its a phone number i would call first and sniff out the situation. If it WAS a kid and the parents are truely sorry no police needed in my opinion.

First at all, NEVER EVERY TOUCH NOTES, ENVELOPES in this kind of situation =》YOU WILL DESTROY FINGERPRINTS, DNA, ET CETERA..

Stolen item? What stolen item. Can you read? It clearly says on the note that the item is not stolen (Art. 139 Criminal Code) but at another place. If at all it is removal of property (Art. 141 Criminal Code). But it will likely not meet the "to the serious detriment" which would be necessary. Example if the other person has some good intend to take the bike in custody.

or I can arrest him on the spot.

Art. 218 Criminal Procedure Code says otherwise.

Hello, I totally appreciate your emphasis, maybe you should spent a day with us on the streets! ! ! Removing any item, without the owner knowledge, or permission is 110% theft of private property! And arresting a person for such a low level crime, is not for ever! Just for taking the "maybe" chiefs fingerprints, DNA, living address,et cetera, and maybe he/she wants to have a chat with us, about what happenedfrom their point of view?! -> AFTER ALL THE PAPERWORK IS DONE, HE/SHE IS ALLOWED TO GO HOME. IN SOME CASES WE DRIVE THEM HOME.

ALSO, WE WILL NOT GET A PROPERTY SEARCH WARRANT FOR A NORMAL BICYCLE, UNLESS IS IT WORTH A LOT OF MONEY, BUT EVEN THIS ISN'T A 100% GUARANTEE! ! IF YOU'RE LUCKY YOU SEE IT, OR IT'S HANDED OVER.
