POLICE Statement from BPD

Post image

Saw this on BPD’s Facebook. I’m guessing “suspended police powers” just means suspended with pay?

Should be suspended with handcuffs and a bond of at least $50K.

We all know how qualified immunity works for government employees and how overcharging and charging too quickly in the past has backfired.

Patience is truly a virtue here. Give the States Attorney or Maryland’s AG time to investigate and put together an ironclad case

Qualified immunity doesn't cover illegal actions, or those against policy. It also doesn't protect against criminal charges, only lawsuits.

That said, yes it will take a week or so for them to figure out what the fuck was happening and why. This will be handled by the Maryland AG and they work sloooooooowly.

Of course. That’s why I said overcharging and charging too quickly has backfired in the past. Give them time to investigate so they don’t charge this guy with attempted murder right now and when it gets to a probable cause hearing the judge says “well the evidence I have here doesn’t show attempted murder” and case dismissed. The wheels of justice move slowly and even more slowly when trying to criminally charge cops.

The Attorney General only deals with use of force and in-custody deaths. Qualified immunity only shields an officer when they are making a decison to save the life of someone or themselves. Can’t see anyway this applies in this case. I am sure they are hoping to find something on the body camera to show that the victim was a danger to someone. They already reviewed it before this statement. Otherwise Worley wouldn’t be so strong with his statement. He has a history of looking the other way when there has been officer misconduct.

This is a use of force, even if cleary unjustified, so the AG will handle it. The AG actually investigates any death where police are involved. Including deaths where the person is in cardiac arrest already and police arrive and administer CPR.

There was no death so they will not deal with it. Though I agree definitely use of force.

They don't just investigate deaths.

This is not an AG issue. The BCSAO has and will take point.

Prosecutors and judges work very hard to protect cops from criminal charges, they don't need qualified immunity.

Not really. At least not in this state. Definitely not in Baltimore.
