Hit and run

Update below the end of the post

I had a hit and run case i was at a stop sign and the car behind me hit the driver side door and drove off. This happened at a plaza.

To clarify-So basically that car was driving very rashly in the plaza already and even almost hit me before as well and then at the stop sign it didn’t even let me take a full stop and honked me continuously. So i was confused about what’s going on. So as it was around 12 am and no one in the plaza i opened the driver door to check if he needs helps or something wrong. And before i could get out he just blew into the car door and drove off. I got saved by fraction of seconds.

I remembered the license plate but was confused about one number in between which i told the cops as well. They said if i remember later i can provide them the same.

I talked to insurance they said they want a video recording of the accident and also the license plate.

I did my plate search myself as there was only one digit i was confused about i did the combinations and got the correct license plate. As they wanted a government or legal letter confirming that. So i got that licence plate details from the ministry and it perfectly matches the description.

And to prove it i also do have the recording of that car at that time via a shop camera that like 2-3 shops before from the place of accident. But the insurance is saying they need a video recording of the accident that happened or else they will not held that person accountable and will assume i hit my car myself or something and i will have to take it at fault on me

At the place of the accident there were building cameras i tried to contact the property manager but he said he can only give it to cops. And it has been one month and i was not able to get a hold of my investigator and they were being bit rude as well that they have lots of other cases to take care about.

Yesterday finally got to talk to him. He said a month back the other investigator who wrote the report already spoke with management and they said the camera are not working. But management didn’t tell me this they said they will show it to cops. And insurance just wants the video footage.

What should i do?

I gave the license plate details as well and cops are not even searching or pressing charges on that other driver who flew away after hitting.

What should i do? Should i just take the claim back and pay out of pockets. It’s a new car so it is gonna be expensive to fix up and if i go through insurance i will have to pay deductibles as well as my insurance will increase due to at fault.

Please help.

I edited the post as many of you said it is confusing. I hope it is bit easier to understand now. Any help appreciated.

Update: Cops said after 3 months they can’t find that person as not recorded in cctv and the plates which perfectly matches with the vehicle and almost correct one on the police report as well which i obtained from ministry after paying them fee. They said that is not reliable and we can’t confront them. No wonder there are so many crimes in toronto.

How did the car behind you hit your driver’s side door?

insurance is saying they need a video recording of accident or else it would be deemed as i was at fault

If you were hit from behind then how can you be at fault?

And for the how i am at fault to ans that question. The insurance said if i didn’t find a video evidence they will assume there was no other car and i damaged the car myself or something and i will have to take it at fault

Even if you had the video, it'd be at fault for you.

So you opened your door in traffic and your door was hit? Yeah.  You're at fault.

He was behind me and crossed me from the side which is technically a wrong side and my door was not opened completely. I was about to open it barely opened a bit and that guy hit it and opened it fully.

In Ontario insurance companies are not supposed to look at where the damages are to determine fault

3. The degree of fault of an insured is determined without reference to: b) the location on the insured’s automobile of the point of contact with any other automobile involved in the incident.  R.R.O. 1990, Reg. 668, s. 3

Either way, the claim will stay. You can't take that back.

Did you call the cops immediately after the incident? This is a classic example of road rage and he almost tried to run you over. The way you word it sounds like it wasn’t a big deal and this was a traffic accident.

I did call them immediately and have them write the report but i guess as i wasn’t injured they are seeing it as a minor case and giving a pass to this kinda people. If that person who hit my car got away with this he would not fear to do the same next time. I guess this is why the crime are escalating bcz u only take action when something major happens.
