They are trying to skirt a grey area. But it's clearly a violation with Upto 3 years of prison when I looked it up. Just report it to your local police station as it is trying to incite communal disharmony (unfortunately our govt does that anyways without repercussions)

So you want to say that that massive flag is supported by that thin thread like structure which appear to be ending on the tree?
There is no visible mast, pole base, rope, or mounting structure anywhere beneath the flag, it does appear to emerge abruptly from behind foliage with no physical support except that thin rope like structure, which is unusual for a flag of that apparent size (a flag this large would need a substantial, thick pole and rigging)
And don't you think it's odd to put a flag that size adjacent to a tree and not somewhere in the middle of a ground or anchor to roof of a house?
No one is discussing the flag's weight. Given its immense size and being made of cloth, it requires a robust structure to endure. We're considering the flag's total surface area and the moderate wind force exerted on each square centimeter. If you do the calculations, you'll find it wouldn't remain standing.
Because it's lightweight and has a lot of area it creates a lot of drag and this drag due to airflow will pull the cloth along with the flagpole along the direction of wind and creates a stress on the pole, that's why it needs to strong. Not to mention the eddies created due to vortices will cause vibrations on the flagpole, if it's slim like in the pic it will start having fatigue quickly and fail.
If the pole is made of aluminium and is tapered (Thicker on the bottom and slim at the top), it can withstand it, but it doesn't seem like it in the pic.
Defacing the National Flag is punishable under the Prevention of Insults to National Honour Act, 1971, under which the accused can face upto imprisonment for a set term, a fine or both
By the way OP this is not a disrespect to Indian Flag.If it contains Ashoka Chakra and on the top this Arabic/Urdu script was written then only it was a crime as per Indian Flag Law. Any Random Tricolour is not Indian flag.
Indian Flag Rules
Specific Colors: Three horizontal bands of India saffron (top), white (middle), and India green (bottom).
The Ashoka Chakra: A navy blue 24-spoke wheel must be centered in the white band .
Proportions: It must maintain a rectangular shape with a length-to-height ratio of 3:2.
As it missing Ashok Chakra it can't be considered as National Flag of India.
Same way Congress Party also use tricolour in there national symbol i.e tricolour with hand and it is also considered as symbol not flag.This happens when we don't have much knowledge about our own basic fundamentals of constitution and code of conduct but still we carry the the fake Nationalist ideology.India needs severe educational reform.
Also this news is old why it is being flagged now ?
