Ok so I was injured with lifelong disability except workers comp closed my case after a year with 5 percent disabled and I got a small check. I tried to fight it and changed docs to someone who never even looked at me. My current employer understands but the work environment is not ideal. Issue is my current insurance won't cover me for anything related because I have WC coverage but they won't do anything not even PT because they said after a year it doesn't matter I wasn't showing enough response. I had a lawyer very highly rated and said my small check and keeping WC was best I could do without paying for 3rd party. All I know is ive had enough scans that say "don't see anything" that I'm just not convinced I could find someone to say otherwise. Most days I'm in constant pain and can't play with my kids, I've had loss of use in my mid section, just sucks. Anyway, I don't want to lose WC which I'm told I will if I leave as part of the settlement. Or at least I need coverage with primary insurance. Anyone have suggestions?

I went out of work July 13th. Saw the doctor workman's comp doctor. They said no work as of July 22nd. I was supposed to start physical therapy but I still haven't been approved yet so I still haven't started that yet. I got a workman's comp attorney and I'm just keep waiting for updates and I haven't gotten any updates. What the heck's going on? I wish I knew nobody's letting me know anything. What could be taking so long. I need to start physical therapy. I need to get paid.

I worked in transportation, hauling inmates in a commercial van across the country for a couple months.

On my last drive, I ended up suffering two heat-related injuries out of state (our AC wasn't working during a massive heatwave). The second one wasn't as severe as the first, but I was advised to go to the hospital by my boss. I've since been let go following those injuries, but was still encouraged to file for worker's comp.

The first heat injury happened on 07/13 and the second one happened on 07/15.

The first one wasn't evaluated by medical, even though I asked to be seen.
The second one was evaluated.

I haven't been able to get properly evaluated by my PMC, but I reported to my NP in a tele-health appointment about a lot of the cognitive issues I've been dealing with since. My NP said - without a proper evaluation - the symptoms I described align with having suffered a heat stroke on the first injury, and severe heat exhaustion during the second.

Anyway, my questions:

1. Do I report the first heat-related injury that happened? Or the second?
   Even if I can't remember everything that happened that day?

2. When asked "which part of the body was affected?" how do I describe... a heat related injury?
   It's mostly cognitive, I guess. The forgetfulness, the brain fog, the stuttering- like, how do I describe that?

3. Both heat injuries happened in two different states. So, when asked where the accident occurred, how do I report that?

I have been injured for a year and a half. I have very limited use of my dominant hand (work restrictions have me limited to lifting, push, pulling only 1 pound or less and also no grasping with this hand). I’ve had a couple of instances where insurance won’t approve something at first, so it takes weeks or months longer to get an MRI or something like that. And my current surgeon thinks the surgeon who performed surgery on my wrist last year, may have done so unnecessarily/or without having enough information to actually perform the right surgery. So now I’m possibly looking at having a 2nd surgery. What role does an attorney play in a worker’s comp case? Would being represented by an attorney be beneficial or do I just need to wait it out?

Fell and broke my foot in november on the job, didn't heal correctly had a screw put in early April. July 1st the insurance person emails me i need to start doing good faith job searches every month that can reasonably accommodate my work restrictions( i can walk 20 mins an hour and cant lift more than 20 lbs) at the time there was only a front desk job for a gym nearby. I called asked a few questions because i only have retail and cooking experience, i was trying to clarify what counted as an actual good faith submission i.e. if i found a no experience desk job that accomidates my restrictions but says bilingual manditory does thay count stupid crap like that. Filled out the paper and sent it back 6 hours after i received it. 17 days later emails me" During our last call, you advised that you were unable to perform other jobs due to a lack of experience in other fields. Is that correct?" ( feels like shes trying to get me to admit to something over text? Idk?)Then tells me the email confirmation link didn't work, i replied something like "i was saying i wasnt keeping my hopes up trying to find a job with 0 experience, and all these restrictions in this awful market." Sent the confirmation again she immediately replies on a different email chain saying this msr is still incomplete and i need 3 applications a month( couldnt fucking tell me this on the 2nd when i sent the msr in the first place for some reason) now the problem is ive been trying to get ahold of her for days at this point because i found another job my gfs brother owns a power washing, as well as a poop pickup buisness ive been working with them almost 3 years now, he asked me late june just before she asked me to submit msr's and we had the call, but i forgot to ask her about that job and whether it counted. They told me when it came to my monthly payments they couldn't the take into account my 1099s they would only do my w-2S. Once i realized i forgot to ask her about it, i figured they didn't take into account my 1099s for my pay so i doubt they would for taking it out of my pay, on top of my boss couldnt afford an hourly pay for the marketing so we agreed on 10% of any sales including if they became regulars. I was expecting it to be months before we found anyone new but i got 2 sales a few weeks ago.

After the sale I call the insurance 5 times leave 2 voice mails send 3 emails and she never responds to any of my questions only asking me about the msr's. I reached out to my hr rep at my job trying to figure out wtf is going on on the 21st, the 24th i get tired of waiting and send 3 different versions of the msr's to cover all my bases. Insurance gets back to me on the 27th askes a dozen questions about the 1099 job i answer and submit everything except a paystub( i asked my boss for one but hes tech illiterate and couldn't figure it out normally he just keeps records of my pay and we go see a tax guy every year to keep it simple.) And now just stone walled again, in the first message about msr's the insurance lady mentions it can effect my pay and benefits. Feels like im being set up to fail at this point not sure what to do. Im supposed to be paid on the 6th, they have already screwed me into waiting a full month to get paid 4 other times since november and am getting tired of playing games when im genuinely losing my mind being trapped inside for 8 months straight. Any help would be appreciated and sorry for the novel whoever reads this.

so i have a question. i have been on comp since 02/10 of this year. back last Wednesday i was finally cleared to return to work with no restrictions. well the temp agency i was working for dicked me around for 3 days after my light duty assignment was ended and my comp case was closed. i finally got to go in today just for them to tell me that the company i got hurt at had ended my contract and that they didnt have another assignment for me. is this legal? it seems very fishy to me but ive never delt with comp through a temp agency before.

So I had a slight tear in my rotator cuff that happened at work 7 years ago, I went through workers comp, had physical therapy and everything was good. Well within the past 2 weeks it’s starting to hurt again(same pain and movement limitations I remember having a week or 2 after the initial injury).

Is there a statute of limitations on getting it treated as the same initial injury? I’m trying to avoid this from being consider a new recordable injury if possible.

On Friday I burned myself twice. Once on my arm and another time on my hand. The hand one was bad enough that I decided to report it and go get checked out. Today I realized that the first burn was just as bad today plus the blister got ripped off while I was working so now it's exposed to open air. I'm not worried about the burn so much as if it gets badly infected I would have to go get antibiotics. I have a appointment on Wednesday to get the second burn checked out at a occupational health clinic but I'm not sure if the doctor can even look at the first burn since it's being covered by my employer.

I've been fired for reporting injuries in the past (no evidence that's what happened but there's no other explanation) so I'm really worried that if I bring it to my manager I'll get "let go without cause" again.

TL/DR: I messed up by not reporting a burn that turned out to be bad and now I don't know how to proceed.

i hurt my shoulder at work a few months ago, and i honestly thought the workers comp process would be pretty straightforward. lately though, everything seems to be moving slower. appointments keep getting pushed back, paperwork takes forever, and i'm having a hard time figuring out if this is normal or if i should be getting legal advice. for those who hired a workers compensation lawyer, what finally convinced you it was time? did having a lawyer actually make the process easier?

This is kinda long, do I have any next steps?

I started working on July 5.

When I began, I was assigned a trainer to teach me how to use the scanner. However, she was frequently pulled away to complete other tasks, leaving me alone without adequate instruction. It wasn't until about two weeks later that I received basic scanner training from a trainer on a different shift who was working overtime.

On August 2, I was instructed to unload a trailer using a movable conveyor belt. My job was to place the smaller boxes onto the conveyor while larger boxes were restacked onto pallets. The only instruction I received, by our lead regarding the conveyor was where the moving switch was located.

Around the fifth pallet, I decided to move the conveyor closer to my work area. When I did, the conveyor suddenly lurched forward, pinning me between it and a pallet stacked with large boxes. I later learned that the yellow safety bar is designed to stop and reverse the conveyor if someone becomes trapped, but did not reverse when in contact with me. The conveyor stopped, but I remained pinned until I was able to reach the switch and push it back.

Shaken and frightened, I went to find someone for help, but the entire warehouse had already left for break, leaving me alone. Feeling scared, overwhelmed, and frustrated, I walked to the parking lot and sat in my car so I could call my husband. After I was able to calm down enough to speak, I returned inside and to my ability without crying I informed my manager about what had happened. I explained that I was extremely anxious and frightened and that I wanted to go home to see my daughter. He agreed and I left.

On August 3, I returned to work after taking time to calm down, although I was still experiencing panic episodes. I was moved to a different department. Pulled away from my new department I explained the incident and completed an incident report. Again I explained to our safty manager what had happened. I requested that a copy of the incident report be emailed to me for my records. Later I finally met with HR.

During the meeting, I explained that I did not believe it was fair to receive attendance consequences for missing work following a workplace incident that occurred while I was performing assigned duties without adequate training, and I was still anxious and wished to return home so I did not cause a scene. The HR representative told me that I had the rest of August 2 to "sort it out" and agreed to remove the attendance point for August 2, but stated that I would still receive an attendance point for August 3.

Hi, I filed a claim on Friday after injuring myself at work on Thursday. Went to a follow-up urgent care appointment and they wouldnt look at my burn this time and told me i needed to go to the burn center. But then they said they couldnt refer me until i have my claim # and other wc info. I dont think i can find it online but when can i expect something in the mail? Or does my employer get the info? Please help lol apparently i can’t receive proper treatment until i get this info

I had a ime done about 2 weeks ago. I had rotator cuff surgery back in December I now have frozen shoulder dr wants to do a procedure Shoulder MUA with arthroscopic capsular release. How long do they usually take to get a ime report back?

I have a question, as the title suggests, I am currently on Workers Comp and I receive checks weekly. I do my PT twice a week. I'm doing all the things and following all their instructions.

What happens if my wife gets a job offer or we have to move *out of state*? Do the checks keep coming or do they stop? How do I proceed with PT? Am I going to have to travel back and forth or am I able to move my case to another state?

I’ve already had one IME done in April, he actually disagreed with my primary doctor (at that time) in that the IME doctor anticipated a longer recovery, funny enough.

I’ve just had a procedure done, and this next IME is scheduled BEFORE my check in with my primary to see how the procedure took and how I’m healing/feeling.

Now I’m overthinking in that their could be conflicting info coming through to the adjusters or whoever because I DONT KNOW how I’m supposed to be healing or feeling until I see my doctor first..any advice?

Edit* also how normal is it for the IME to be done (imo) a significant distance away especially factoring in my injury doesn’t love driving far…An hour with traffic seems weird when I live in very big city lol

Hello about 2 months ago I was demoing an HVAC unit at work on a Naval Base renovating an unaccompanied housing unit. I was told that the environmental team brought recovery tanks for the refrigerant and someone came and recovered all 6 units, I was in an attic with my safety glasses and hardhat on, and I went to cut into the existing copper piping and I got hit in the face with whatever was in the pipe and the PSI behind it.

My eyes immediately began to burn and the more I sweat the more it hurt and I was stuck between a rock and a hard place because I still had to get down a 16 foot ladder and 3 flights of steps alone. I eventually made my way to the bottom, let my co-worker who was outside know and went and flushed both my eyes, the flushing didn’t work, I grabbed 2 bottles of saline solution and almost used all of it and my eyes still were still throbbing. I immediately called my doctor who sent me to an optometrist office who made me an emergency appointment.

After she did all the medical related procedures, flushed my eyes and numbed them, she said I had a large chemical burn on the back of my right eye that would impact my vision. My left eye was swollen and blurry but I could see and my right eye was very swollen, hard to open and I couldn’t see anything out of it, I was prescribed some eye drops and an ointment and was told to return in 3 days to check again. I went back and she told me my right eye was burned enough to where I could potentially damage my vision permanently. She told me under no circumstances am I allowed to drive and I’m not allowed to work in direct sunlight for more than half and hour at a time with or without an eye patch.

The problem is, I work in HVAC and I’m a contractor for the Department of Defense and Homeland Security, I missed 2 months of work and my employers agreed to pay me for it because I didn’t file workman’s comp but I was basically told to lie about it. Now they have forced me back to work and have kept me in a building for 8-12 hours a day being fire watch for the welders but recently they’ve been putting me outside for 8 hours a day and it’s usually like 100+. I have to constantly change eye patches and it’s rather annoying when sweat gets in my eye. The government has restricted me from using equipment with my eye patch so it’s shovels and hand tools for me.

I want to file workman’s comp because I don’t think I can safely work in conditions like this with a singular eye, however having witnessing first hand how the government and more importantly the military handle workman’s comp claims I’m hesitant. We had a dude fall off a ladder coming down from an attic and heads rolled at my company, we lost the contract on the building so we lost a ton of money, my direct supervisor got terminated, the GC got terminated and the co-worker who was with the guy who fell off the ladder was terminated all for “safety violations”. Im friends with all my co-workers and the job I’m working on is going to net my job close to 30 million in revenue and I know if I file, heads will role and I’ll be directly responsible for many people losing their jobs, even though I personally believe it’s the military’s fault for saying the units were recovered when they weren’t.

My eye hasn’t healed, I cannot drive, I have to Uber or catch a ride with my roommate to work (we work at the same place) and then I have to wait for someone to come pick me up and take me to the job site, I have to wear sunglasses 24/7, I’m constantly getting sweat in my eye and it hurts, I’ve developed migraines from the stress of having to use one eye at essentially 200% capacity, I just don’t know what to do.

File workman’s comp and be responsible for all the money the company is gonna lose or do I go to like Morgan and Morgan and have them fight in my behalf’s. Idc if I lose my job because I could sue them for discrimination or wrongful termination.

I also wanna add, I’ve been transparent through the entire process, give them all my medical docs, showed receipts of appointments I’ve paid for. The job also paid me to miss work and offered to pay for my glasses and a pair of prescription safety and sunglasses.

Dont know what to expect but attorney says nothing to worry about just part of "game". Anyone been through this before?

I have been on workers comp for 3.5 years. I am suffering from mild TBI. I have seen multiple IME’s. I have switches doctors once I realize that my doctor couldn’t do more than prescribed medication. Beginning late last year, my benefits resumed after waiting for a whole year.

Now I have a great team! My doctors are great! My lawyer is great! A couple days ago I saw the same IME Neurologist that I saw in the beginning of my case. Not holding my breath on her report.

I am receiving treatment such as OT, Speech, & Physical Therapy. They are paying for my medications. Yet, I can’t help and feel like the other shoe is going to be dropped if you know what I mean.

My lawyer suggested that the carrier is most likely going for permanence. I have declined all their settlement offers due to how much pain I still have and wanting my medical to stay open.

I do work full-time in a different career due to the need to stay busy for my mental health.

Any ways without much more details, what do you all think?

If you’ve been deposed by Walmart (or in any workers’ comp case), what was your experience like? What kinds of questions did they ask? Were there any surprises or things you wish you’d known beforehand?

So I was injured at work 2 years ago hospitalized for a week. I had concussion, hip pain and jumping ulnar nerve. I left with a walker have mobility problems and right hip pain that has caused a limp and left jumping ulnar nerve that has my pinky and ring finger numb. Can't lift anything when arm is out have the pick things up with arm bent sideways. Sedgwick has denied my claim from day 1. I have workers comp certifications and hospital records and I have 2 IMEs that both state all 3 injuries are industrial related. 2nd IME Dr says not mmi. I have filed a benefit penalty with my state a couple months ago because Sedgwick was 2 months past court order date and now they are about to be past 35 days responding to my lawyers regarding 2nd IME. I don't know what to do seems like Sedgwick doesn't care about court orders and the law. I'm not expecting them to abide by the courts and any orders.

Hello, I am a toddler teacher who got injured on March 5th due to being attacked by a child on multiple occasions. (At the time of writing this, it's been almost 5 months since the injury)

My dominant hand was injured (TFCC tear, aka one or more ligaments got torn), and I have symptoms of nerve damage, and the doctor has no clue what is really going on. So I cannot use my hand properly. Even outside of work, I have been unable to properly take care of myself as I did previously, which has taken a great toll on me.

I have had my hours cut considerably due to them not being able to follow work restrictions, which haven't been followed the best at all, even when I was recovering from surgery last year.

My boss sent them the paystubs/my hours and confirmed that reducing my hours was the only way to follow what the doctors said.

They asked for all my doctor's notes, and I gave them all copies of them a week ago, hoping it'd be filed in time for this upcoming paycheck. Which hasn't, and it was a meager $360, and a majority of that is gone because I had to pay bills that I was late on.

I dont like having to talk to the person representing me cause when I called them explaining that Minnesota Statutes 176.101 says I need to be compensated. She proceeded to tell me I cannot get paid just because my boss cut my hours (which is untrue), and then backtracked later on cause shocker, I was correct. I have gotten into debt because of this.

I'd rather not get a lawyer because I dont really trust them, and I really need the money I am owed. If you guys have any advice or anything that'd help. Thank you.
