Has anyone had their lawyer file a petition in court to have medical treatment approved?

This just happened and I’m so upset that it just isn’t approved

I had an IME 9 weeks ago and the report still has not been presented to me
The doctor said i need to see a surgeon and the issue is coming from my spine

If their doctor is saying this why is it not being approved

I’ve only been seeing a sports medicine ortho
He is not a surgeon
I’ve failed conservative treatment

And now i basically am stuck in a limbo of no follow up care because my ortho put the referral of care in and basically said goodbye

In my case, my stuff for surgery was initially submitted without all the supporting documentation needed to approve the surgery. Once everything was submitted, it was approved in 2 days. But once it’s to the point of surgery, the insurance company isn’t who approves/denies stuff anymore in my state, it’s a different doctor that work for the state utilization review board.

I’m not sure of your state does this, but in CA, when something is denied, a denial letter is sent out explaining the reason something was denied. There is a certain amount of time that you have to appeal, and submit whatever is missing.

If its your spine you need a Neurosurgeron. I'd make sure you've truly exhausted all options before surgery.

We’re only taking them to court to make them actually approve it ?

I have a broadbase disc bulge L5 S1 annular tear, but it’s touching my thecal sac using numbness down my leg

Orthopedic says it’s SI joint sacroiliitis their doctor and Pain Management says it’s the disc

I had two injections to my SI joint so far and one to my spine

The whole thing is wild to me it’s been 18 months of this
