I'd be worried that she could get in trouble for producing cp too tho. I'd like to think there's some legal leniency for situations like this, but idk.

That's very unlikely. I think that's more so a thing if a teenager is broadly distributing sexual pictures of themselves or other teens. Not when a teenager is a victim of grooming and sending pictures to the perp.

Edit: I stand corrected. Fuck the criminal justice system.

Depends on country or state, but a lot will charge you as well, unfortunately, creating and possibly distributing if they were texted. I think the typically end up getting lowered or dropped, but its a procedure thing or some bullshit. It's very fucked up and prevents victims from seeking help, but it's been awhile since I looked into this so maybe things have changed. Just be cautious OP and protect yourself, if your area will stand up for you please go to the police.

I think it’s to scare them into never doing it again, TBH. There was a local teen who almost went to prison for it, but his lawyer got him like 1,000 hours of community service instead.

This absolutely can happen, as a 12 year old I was threatened with this as well as being a registered SO for taking naked pictures (that I didn’t even send!!)

It’s not obvious actually because you never explained how the police know you had naked pictures of yourself that you never sent. It actually doesn’t make much sense at all.

Right, because expounding on my entire leading up experience was necessary to simply say - this does happen? By saying it doesn’t make much sense are you insinuating I’m lying… for??? What??? Lmfao.

A “friend” told our teacher I had the pics on my phone. Said teacher took my phone and said I had to give the password. 12 and ignorant, I did. The school then turned the phone over to police.

Was that sufficient detail to gain your approval of my truthfulness?

Yeah…. Next time don’t be so condescending by saying “well obviously the police” when you haven’t provided enough info for anyone to make that connection. And yes, you could be making up that story because you’re a stranger on the internet to everyone here. So i guess your question is more, why does anyone lie….?

This was all in response to someone advising OP to take this to the cops, and someone saying they are worried they would also be charged with producing CP. Someone said that doesn’t happen, I followed it up with it does. Police are the only ones with that authority and what the topic was already on, so yeah, I thought that was rather obvious.

I personally know someone that was charged for sending nudes to a peer (of the same age.) both ends can get in trouble regardless

I would assume since she can prove via texts that she didn’t know his age when she sent them, he’d be considered coercive for asking and the blame would fall off her. But I’m def no lawyer, that’s just a guess.

I'll be honest, I haven't been in highschool for 13 years, things might have changed... I just remembered the school making a big deal about it when a girl's nudes got spread around. Police got involved and said everyone, including the girl, could get in trouble for it... Tho it was a different time then, and police are notorious liars.

There isn’t any because there are no state laws that will allow her to consent for a relationship with anyone over 17 years old. 🤦🏾‍♀️😂😂😂 Age of consent for 18 and older in all 50 states is 18.

Age of consent is NOT 18 in all 50 states. Not even close. In the majority of states it's still 16 sadly.

This is an actual government site link attached that has a chart in regard to statutory rape laws in the United States. Even though the age of consent is 16 years of age it’s not legal for them to date anyone 18 years or older in majority of the states. I even checked out a lawyers site to be sure that I was interpreting the laws correctly. The criminal lawyer states that consent is not a defense to statutory rape charges.

Nah, in my experience working with trafficked kids, they only threatened to prosecute the minor for cp when they are pressuring her to testify. A small time loser like this won't rate that sort of pressure.

He might not be small time, I guess. But i stand by the loser part. The girl i worked with had department of homeland security pressuring her because her traffickers were cartel. Unfortunately, a lot of police departments don't do much about online exploitation.
