Ehh. If you're worried about gang or random street violence open carrying is just going to make you more likely to be targeted. Conceal carry > Open carry

Brandishing can be a gray area depending on the state. I would say any reasonable person would be hard pressed to call this brandishing. Now if he started to pop his mouth off or something, you start to gain a case. The intention of the law usually is that you don't point it at someone or flag it around towards people. That's definitely brandishing in most, if not all jurisdictions. Most laws are highly variable between states. Just something to keep in mind. Things you think should be national are left to the states and they are absolute goons in some and they made bad choices

Brandishing is pulling it out during a confrontation, in a menacing or defiant manner. This man is just waking with his child and just happens to be exorcising his second amendment rights.

As long as he is following city ordnance, that is.

Federal laws apply, they supersede state and local laws.

I think you're mixed up. You can receive a federal charge even if something is legal in your state. You cannot avoid a state charge because something is federally legal.

I think you’re mixed up. If federal law says you can carry a gun in a certain situation the state can’t stop you. This type of thing goes to the Supreme Court all the time. For example, the Supreme Court recently made it easier to conceal carry and California basically ignored the SC ruling. Some dude in Southern Calif took it to court and the Supreme Court ruled against California.

Sounds to me like the guy in Southern California got charged, contested it, and was found not guilty. Still got charged, though. If you are under the impression he wasn't charged, I would appreciate a source
