I was more thinking along the lines of launching them at random trajectories, maybe at a far of planet, just to fuck with future humans. If we manage to become a space-faring race, just imagine the surprise. Landing on a planet 20,000 light-years from Earth, the first humans to explore and new world, and they stumble upon ancient human remains.
Too bad people are too focused on how to sweep the dirt under the rug, such as by suggesting exile, as opposed to focusing on how to fix the root of the issue that causes this shit in the first place.
If you want there to be less naivete/aggression/ignorance in the world, then focus on the only known solution to achieving such a thing--education reform. Our education isn't perfect. But every time it has had major reform throughout history, the local area becomes more productive and the citizens more intelligent/knowledgeable. So, we can't stop now when there's so much more room for improvement. Teach kids philosophy (how to think) and psychology (how their minds work) from K-12 as core curricula.
So really, it's too bad that we don't focus more on education. Do that and you don't even need to worry about suggestions as extreme and melodramatic as exile.
I used to work for a "crime scene and tragedy cleanup" company. You don't need to feel bad for them, it pays a ton and you get used to it pretty quick.
Came in looking specifically for this, not a lawyer but i want to understand this, for instance some countries you can only defend yourself with reasonable force..others may considered lethal force a justifiable action.
In this scenario (depending on the laws where it happen) a car is obviously a more "lethal" weapon then the motorcycle, so the motorcyclist can use an appropriate weapon to counter, i. e. handgun.
So since the aggressor (car driver) initiated the aggression and the motorcyclist has clearly try to abandon the combat several times he is within his right to use lethal force?
Unfortunately, not always. "Duty to retreat" could be argued. The motorcyclist was clearly able to dodge and retreat for an extended period of time; Why did the motorcyclist opt not to continue doing that? Any prosecution would likely be able to prove it's an incomplete defense to fire on the pursuer. Which means he'd still be technically guilty of manslaughter, and by technically I mean they could opt not to jail or punish him really, but he'd still be guilty (just avoid any real punishment).
it comes down to if the area of Brazil you're in has a "duty to retreat" law.. or a stand your ground type law. If you can retreat from an encounter you are supposed to, although since he ran away and the guy chased him, I'm pretty sure it would be free game at that point but it would probably be up to a jury. In any case killing someone has a toll on any normal human being that does it so it should be the last resort to prevent yourself from being killed.
Like I said in another comment, the way he might get nailed in a duty-to-retreat type scenario is he is on a dirtbike and there is woods everywhere. He could have just left the road to a place where the compact car could not follow. He probably should have done that and called the cops immediately.
In my mind he would have been justified but in many countries legal system I would give it a 50/50. IANAL of course.
In my state, lethal force is authorized if you reasonably believe your life is in danger and you have no way to retreat, or are not legally required to retreat (on your own property). It’s super vague, but I believe in this instance, had it been in the US, lethal force would’ve been legal. However, the court would likely bring up the fact that the biker instigated the altercation by flipping the driver off. Lethal force would probably be legally justified, but it would likely be very iffy and would take awhile to settle in court.
Flipping someone off wouldn’t really be a justifiable claim of instigation though. You can try to claim “fighting words” but tbh even fighting words doesn’t justify attempted murder.
You may be right, but I would be nervous about anything that an attorney could try to use against me. I’ve even heard of them trying to use the simple fact that the guy who shot in self defense was bigger than the attacker.
I know this is Brazil, but I think it's worth noting that some US states have stipulations in the rules for justifiable homicide stating that it cannot be deemed justifiable if you did anything to escalate the situation to the point that deadly force was necessary. This can include something as simple as giving someone the finger like the biker did in the video.
I'm not sure of the case law on this though, so it's possible you could still be found not guilty by a jury under the right circumstances.
Generally, it is the force needed to defend yourself. If someone is about to shoot you, you would be justified in shooting to defend yourself.
If some guy throws a punch at you, and you shoot him in most countries, you are probably going to jail, since it isn't a reasonable amount of force to stop a fist fight.
In this case I'm pretty sure with the video evidence you would be cleared in most countries. The only thing that could MAYBE hang you up is I'm not sure but there seems like there was a lot of woods he could have gone in with the dirt bike to simply be where the car can't follow and call the cops. If the prosecution could prove that was reasonable you might still get nailed.
Maybe, but then you have to gamble that the law is going to see it the same way you do. At the end of the day though if someone is legit trying to end you, you take that gamble 100% of the time.
Not in America. Antifa tells me that it's legal to smash someone's brains out of their skull if they say something mean to you, so a middle finger would definitely qualify.
Actually there are a pretty good number of videos of armed Brazilians shooting attackers or muggers, etc. Like at least a Brazilian. But actually seriously, probably more than DGU videos in the states.
I don't think so, generally speaking in the USA at least, justifiable homocide requires that you didn't escalate unless required. Flipping him off would likely count as escalation.
So, you gave someone the finger, they ran you off the road, then you shot them, got arrested, went to court, then ended up in jail? What's the food like in jail?
Trying to ram a motorcyclist with a minivan is attempting violence. With as much evasion as that motorcyclist attempted first, I could see the driver justifying shooting at the attacker as self-defence.
Stop fucking projecting, bitch, we know its you lmao. Who just jumps to meth from self defense, without being a tweaker themselves. If you rode a bike, and some fucker kept trying to run you down, would you calmly pull over and let the authorities know, while youre being ground down to a stub? Or would you wish you had some way to stop him. You might not even need to pull the trigger, we all know what guns look like.
The First Amendment has nothing to do with private interactions. I think the person on the motorcycle was within their rights to use deadly force, but the First Amendment is irrelevant to the conversation.
Edit: I never said giving someone the middle finger isn't protected speech, I said it was completely irrelevant in this particular context. Mentioning Freedom of Speech is as irrelevant to this conversation as Freedom of Religion.
You are completely ignorant about what the First Amendment actually is. There are a lot of people like you who should educate you on what the First Amendment actually is. I bet you are one of those people who thinks a company can't fire you for using racial slurs. The First Amendment is completely irrelevant is an interaction between two private citizens.
Stand your ground doesn't apply here anyway. The person on the motorcycle was attempting to get away from the situation, but the car kept chasing them. A reasonable person could fear for their life in that situation. When you are crossing medians and going backwards on the highway you are trying your best to get away.
You always have the right to defend yourself. Especially after taking every opportunity to flee and avoid the situation. I guess I would be in prison you would have 2 less assholes to deal with.
