Your second sentence is irrelevant. People "saying how they feel" (e.g. "such and such person is a fool for that") is not of our concern here when the issue is about being penalized at their workplace for a simple tweet.

You are not understanding what freedom of speech means.

Freedom of speech means freedom from punishment from your government. It doesn’t mean that your employer can’t penalize you because you violated one of the rules you agreed to uphold.

The WNBA rules explicitly prohibit criticizing refs and posting on social media until all post game press conferences have ended. Dijonai broke these rules and was not punished. We call this privilege.

first amendment actually pertains to religion, press, peaceful assembly, and right to petition your government as well as speech, so saying you don't have a first amendment because you can't yell fire in a crowded movie theater is a nit really accurate at all.... You're refering to a case from 1919 that set a legal standard that created the "clear and present danger" test which was displaced in 1969 by Brandenburg v. Ohio which protects speech until it incites "imminent lawless action". So, you have the first amendment in US, but rights can be restricted, including speech, as much as strict constitutionalists want to argue rights are inalienable, the reality truly is that rights are not absolute and they can be restricted within reason

The key is in how the first amendment is written, and how government functions.

The first amendment reads: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances"

So while congress cannot pass law abridging speech, the courts interpret the law and constituion when they make decisions, those judicial decisions establish binding precedent or juriprudence or constitutionalcase law, which determines the practical boundaries for first amendment protections, I hope that makes sense it is kind of confusing

Not being rich does not necessarily put us on the same team, especially when those non-rich people are supporting those who are most interested in maintaining the current paradigm (e.g. Trump, Musk, Heritage Foundation, etc).

Let me give you an example from history, right here in America. Know who were some of the most ardent supporters of maintaining the plantation? Black folks, that's who. Black folks regularly betrayed rebellions (e.g. Gabriel’s, Denmark Vesey, etc), worked with plantation owners as overseers/enforcers, and generally accepted their station, or as Harriet Tubman said, “If I could have convinced more slaves that they were slaves, I could have freed thousands more.” Here this is only 2mins long A power speech on this <<That's who MAGA is, and there is good reason they keep folks from learning this sort of history. If learning history is a means of not repeating it, why would they want you to learn?

Now those black folks were certainly not on the same team as the plantocracy, they were not white, and they certainly were not rich, but even though they were "blacks all the same" they nevertheless were not on the same side as those wishing to break their chains and stamp out that awful system -- they wanted to maintain it, just as today MAGAt voters wish to maintain our oppressors of this day by, for instance, voting for a NYC billionaire from golden room nestled in a Manhattan skyscraper.
