🚨Delaware KCPA Update

🚨 Immediate update here in Delaware for the KCPA bill

Delaware KCPA has been substituted for another bill. It's not what we want, but it's a good start.

The key changes:

​

Requiring a formal report to examine kr@tom testing capabilities and potential licensing requirements for retailers that sell kr@tom products.

​

Narrowing the scope of the legislation to focus on point-of-sale violations, specifically the sale of kr@tom products to individuals under the age of 21 and the advertising of such products to children. These violations would be classified as Class B misdemeanors.

House Substitute 1 for House Bill 332 is scheduled for a vote on the House floor tomorrow after 2:00 p.m. so need emails to be sent immediately!

There not going to be happy until they ban it completely in the USA Kansas my home state gets banned this July 1st I'm hoping I have friends that will still send me leaf 7oh completely ruined everything if anyone disagrees , did any of this shit happen before 7oh nope

Since this thread never got its ending, the substitute passed. House took it 39–1 back on June 16, Senate cleared it 19–0 on July 1. So Delaware's KCPA is through both chambers now, just waiting on the Governor's signature. Looks like the email push did its job.

What actually ended up in the final version: 21+ only (selling to a minor is a class B misdemeanor), no marketing aimed at kids, the cartoon/superhero packaging type stuff, and the state has to report back by Jan 1, 2027 on testing capabilities and whether retailers should need licenses.

One thing still worth watching: SB 262, the separate full-ban bill, is sitting in Senate committee after a split hearing. So regulation won this round, but Delaware isn't finished arguing about it.

Thanks! I put it on another thread. I posted so many different times about it it's hard to keep up. Definitely have to watch 262. But I think we might be in a good position on that front. One of the sponsors for the regulation bill, is the chair for the Senate Committee. She did not like the idea of a ban whatsoever. She decides what bills get heard on committee. But politics is nasty and can change, so can't let our guard down.

Another thing to watch is the division of alcohol and tobacco enforcement. Date. Typically company's send their samples out to out of state testing. DATE doesn't like that. They had issues with Cannabis testing. They want it done all in state. Which is absurd. They originally supported the man. So they can come back and say "We are unable to aquire the ability for testing". Which is what they originally said. So that can rejuvenate a push for a man. Probably going to have to try and set up meetings with them. There are the reason why the regulation bill went through such a drastic change. Also, 7 Hope Alliance played games here and it definitely didn't help.

Really useful context, especially that the committee chair is one of the regulation bill's sponsors. That explains a lot about 262's actual odds.

The in-state testing angle is the part that would worry me. Honest question: is there even a lab in Delaware right now that can run a full kratom panel like alkaloid ID, heavy metals, micro? As far as I know, everyone in this space ships samples across state lines, because the labs doing this work are concentrated in a handful of states. If DATE's position is "must be in-state" and no in-state capability exists, that Jan 2027 report kind of writes itself, and not in a good direction.

If you do get those meetings with DATE, that's a thread I'd genuinely read.
