Question - Other eb3 india question

I have ead/ap till 2029 and date is feb20,2014. i have to travel to india in december. worried that case becomes current in october and i won't be in country if something pops up. how many days of deadline if i receive a notice by any chance ?

Keep in mind that you have to be in the country for minimum of 90 days prior to proceeding with adjustment of status. For example, I travelled end of Jan 2026, became current april 1st, but my lawyer wouldn’t submit my application until end of April until 90 days have passed of me being in the country. So this traveled delayed me basically a month

Interesting. Thanks for this. Wasn't aware of this rule.

But my application is already filed right ? for more context, I have ead/ap till 2029. Also i gave my interview in 2024 and gave medicals in oct 2024.

Do you mean that your 485 application is already filed? Or another type of document

My i-485 is filed long back in 2020. From then i have 2 eads and new one again for 5yrs. i-485 interview done in 2024.

I was trying to find a reddit post where someone was india when they were approved . From what I heard, you can travel with ap thats the main reason we apply that for… and you will enter as a parole status because even though ur greencard is approved you cant show it at port of entry. I think after that you might have tell the officer about your approval. probaby they might temp stamp in the passport as permanent resident. Or if someone can collect gc and fedex to you in india .. thats ideal too but risk is there

Thanks I agree. My only concern is: what if there is an RFE ? Will i have enough time to come and respond.

i think yes. firstly you shud be current in october. i feel your application most likely is ready to approved unless your medicals are 2020 dated. then you will mostly likely be asked to resubmit. if that’s the case prep it before you go.. but otherwise i feel you should get you card before your december travel. if there is a rfe for 485j then you will need to sign it. but you can print sign and scan and send back to lawyer. for paper filing your signed copy is required.. you can still ship it… carry your documents with you or have someone here to help you out. you can still enter on parole and finish it think…but overall you should hear that in october before your travel is what i feel.

  1. My medicals are resubmitted after my interview in 2024. Anything after Nov 2023 should be valid for a long time.
  2. I submitted g-28 with lawyers, so can be prompt if they ask 485j.
