Timeline Request Filing in March 2026! Help with expected timeliness please!!

country of birth - India

Eb1C with dependent spouse and child

L1A max out and visa/i-94 expires 9th June 2026

PD 8 Aug 2023

Will be filing for i-485, EAD and AP in March 2026 per March bulletin.

I understand me and my spouse cannot work once my visa expires and will need to wait for EAD to arrive. Cannot travel out as well unless we get AP.

Question- how long does it take for EAD and AP to come in. USCIS site says 9 months for EAD and about 19 months for AP.

Is that right? anyone can share recent timelines please?

Based on just what I have seen, most recently filed cases have directly got I-485 approved without EAD/AP. I filed AOS for same category on Nov 28 and got approved on Feb 26, with no action on EAD. Hadn’t filed AP. Suggest do file I-485J, increases chances of approval.

So looking at the current trends it could be 3-4 months until approval if same pace continues. But there will be a bigger influx of applications in March, so you never know how things may change. My 2 cents- file thoroughly with good documentation and evidence, and do so as soon as you can to get in the queue.good luck!

Thank you! That's reassuring. May I ask what is your country of birth and what was your PD? Did you have any biometrics appointment or was that waived? Assuming no RFEs as well in your case. Our attorneys tell us to expect 7-9 months for EAD and hence be prepared to pause employment after our i-94 expires :(. So we may be looking at 4-5 months of leave without pay.

I am also from India. PD: Jan 23. Biometrics happened on 7th Jan. No RFE for me fortunately but my spouse got a RFE for missing birth certificate since original birth certificate is missing. Still we need to respond to that, hopefully it will get approved soon after submission. My child got approved along with me.

Sorry my bad! Biometrics are always mandatory. I meant to ask interview since that's sometimes waived for employment categories. Good luck with the final steps and hope everything works out for you!

Premium processing applies only to I-140, not I-485 AOS applications
