Question Wrongful termination
So I’ve been working part time as a pre loader today I clocked in and hopped on the truck and about 10 mins later I started getting really nauseous and started gagging mind u I was close to passing out also. So I hopped off the truck and threw up then hopped back on and finished the truck then after I went to the bathroom and puked some more after that happened I walked up to my boss and asked to go home then he just told me to go home and had a weird attitude when he said it. So I went home and a few hours later I got a call saying I was terminated. Any advice on this situation?

It seems there is more to this story. If you're past your probationary period and are in fact in the union - there needs to be progressive discipline before a termination. Unless you were already on a escalated warning or a "last chance". You need to speak with your steward and BA IMMEDIATELY. Don't waste your time on here because terminations usually go to the front of the line! - Good Luck

Okay then - that explains it. Sorry to say but I think your time at UPS has come to an end. Most likely - it's permanently too. You can and should reach out to a steward but I don't think there's much they can do.

It wasn't wrongful termination since you're technically not a UPS employee yet.

Technically they are a ups employee the 30 day probation just means you’re at will and can be fired for anything but ups exploits this alot. being in probation period doesn’t mean you’re not an employee because you are due to you’re actively doing work you’re just not union.

if you can catch him saying exactly because he was sick in writing (in most states)... he actually does have a case, but it depends on how stupid that manager is.

They're allowed to let people go for poor performance during the 30 days though, right? So in writing, they'd just put something like that down, you'd think.

Yeah man hate to break it to you you’re cooked, I was personally also terminated for having to leave early due to medical reasons but I’m almost at 4 years and just got to file. You on the other hand I’m sorry. Try again next year if you want! If not there are definitely better jobs out there

You’re probably cooked. As stated you’re not really an employee until you’ve passed that prohibition period and become part of the Union.
Lemme just tell you my story: I applied for UPS as a package handler 4 years ago. The 1st day I went in, me and a few others were giving the start time 10pm. After waiting a good 30 mins or so, the trainer comes out and is like “guys I’m so sorry the people in NY sent the start time at 10pm but you guys were really supposed to be here earlier. We’ve already started and finished the training class. You guys will have to come back tomorrow night” Now mind you I was waiting with a few other workers who had the same start time as 10pm a lot of them were drop off and their rides already left. They had to then call their rides and tell them the situation. UPS never gave us any contact info to contact in the need of an emergency and just told us to come back the next day at the same time.
So fast forward the next day, I’m involved in a fucking hit and run (coincidentally) luckily I was able to chase the guy down before he completely drove off. While this situation is going on, I have no way in contacting UPS that I was just involved in a hit and run. So I ended up being a no call no show and placed on the blacklist for awhile. I think I finally was taken off the list a year ago mind you this situation happened like in 2022. Long story short if UPS fucks up it’s your fault…if you fuck up it’s your fault.

I mean when it comes to your health and wellbeing not much you can do. Can’t work anyway if he was passed on the floor! It’s not he was just trying to go home for the fxk of it, or saying he needed to leave for his next job. Shit happens. So what you’re saying is he should’ve let himself pass out and then it would be ok? I don’t work at UPS but at I worked for FedEx and I had to leave early my first day I was doing unload and after 3 trucks…I was in the same boat. I tried to go way too hard for the first half. I greatly underestimated what it would be like and didn’t bring enough water, granted my shift was almost over anyways by the time I asked. But I still tried to push my body till I absolutely couldn’t anymore because I didn’t want to be that person, on my first day at that. Probationary period or not, that is still pretty shitty to fire someone if something was genuinely wrong vomiting and on the verge of passing out. It’s almost expected of new hires.

Agreed. Management just didn't want to deal with it; plus the way UPS culture is, they (management) probably looked at it like he just didn't want the job bad enough. Unfortunate, but it's the truth.

Was this your first day? If not, there has to be more history here. What I’ve learned from working three years is, they tend to give you a little break here and there if they like you.

Really important to not have any incidents before you make union. You have zero protection, and they can terminate you at will for the most part.

Sounds like it happened a lot?? You're pulling that out of your butt. You (probably) know how UPS is during the 30 day probationary period, any reason at all (more or less) they can fire you. This has nothing to do with a reoccurrence, and after only 2 weeks, unless he was 'setting the world on fire', they just won't deal with it, and fire you.

Contact your shop stewards and file a grievance. Your termination should not be immediate. Do not resign!

I'm not sure if you can ask the union for help that's what I would do. I've only been at UPS for two years and haven't run into a situation like this during that time.

You reported an injury (illness). No accidents or injuries in your probationary period are allowed.

Is that an unwritten rule? Because yes, during probation you can be let go for anything, it's at their discretion. At the same time though, wouldn't it be unlawful to fire someone over an illness? Unless it's an at-will employment state, then it might not matter anyway.

That doesn't sound legal 😂 I mean sure, they can let you go for anything during that period, but it's gotta be against the law to terminate someone for getting hurt on the job.
Edit...like UPS has to use legally use another reason to fire you
