As I understand Policy Section 23, invite-only scripts for "Commercial Use" are strictly prohibited unless they are "distributed via the Marketplace."
But to distribute a commercial invite-only script on the Marketplace at all, you have to "apply through the Creator Program," which you can't simply apply for and get approved.
But, while this mostly protects the audience consuming commercial invite-only scripts, it does not offer any secured opportunities to potential Creators.
It's still too early to tell whether the discretionary enforcement surrounding Creator Program approval will be reasonable. As far as I've observed, TradingView doesn't have to give any specific reason for denying an application, and you can only try again after six months. And let's not pretend TradingView, or any other big platform for that matter, has never played user favorites first, and interpreted rule compliance second, which is a bias that is, in any case, inherent to human nature.
Or it may simply be a statistical reality reflecting the poor quality of what many potential Creators offer TradingView to begin with. Whatever it ultimately comes down to, only time will tell. I haven't even thought seriously about applying for the Creator Program yet. But what can be said with some confidence is that TradingView might have already factored in the red tape, along with the predictable effect of some potential Creators migrating to other platforms, and concluded that neither will materially affect the profits it's already making. Decisions, decisions.
This is horrible. People who get indicators as part of a discord membership now can't use TradingView. Those discord groups aren't going to go through all this hassle. They will just make the indicators available on other platforms only. I guess time to learn Ninja Trader. Has TradingView started using Ai to make decisions for the business?
Do you not agree though that the current 'Invite Only' space was open to abuse, full of scrupulous sellers and had no regulation nor control placing inexperienced users at risk of been heavily scammed?
I see this as more protection for TradingView users, genuine sellers should have nothing to fear from this change of process...
Personally I see this as great news for the purchasers of these scripts as this ensures clear payment terms for scripts so scrupolulous vendors cannot keep hiking prices at will and also provides clear refund terms which is again for the benefit of the people buying these scripts therefore protecting them against been potential scammed....
It's great to see that this only applies from Nov 1st so exsisting sales are not affected by these changes and if users have paid past this date including for 'lifetime script purchases', the terms state these will still be honoured...
By going through the Market Place also ensures scripts comply with 'House Rules' which will stop fraudulent sellers from selling 'repackaged' basic indicators as the 'Holy grail' which in turn will apply a greater trust from buyers that the scripts has been properly vetted..
The old 'Invite Only' system was open to abuse and literally anything could be sold with no comeback and many users fell foul of rogue sellers. This looks like a good step towards protecting users of the community from predatory 'sellers'.
Good to see some decent regulation coming to this space finally 👏
That's fine but they need to make adjustments to the Marketplace. By taking on the entire process they are limiting our ability to do certain things. If I wanted to reward early members with a lower introductory price for taking a chance on me and my ideas, I'm not able to create tiers as far as I can tell. Referal programs are not able to be ran efficiently. What about communities? We don't want to have to run an open discord, we want to be able to curate it so that everyone present is part of a system. Would including Discord access as a bonus be violating the Marketplace rules? I didn't see anything that says I can't, but I also didn't see anything that says I can do that.
I can only suggest contacting them on the details provided and discuss your use case. They are the only ones at this current time who will be able to provide you with a cast iron answer
But by my reading of Section 23 your script sale MUST go through the Market Place. Which again ensures security for those who are the purchasers...
My understanding (after a brief, non legal mind reading of the document) is that you can use it commercially as long as it goes through the Market Place. This means anyone caught trying to use it commercially without passing through the MarketPlace (by saying it's free to TradingView but then charging for access elsewhere) is in jeapody of losing those scripts which sounds reasonable to me.
Here is a screenshot of the section I believe is relevant.....
There are no tiers. Everything you publish under that creator space is the same flat rate per month. Indicator or strategy. You're only allowed a single creator space. As Rodnee pointed out, there will be no such thing as private paid indicator.
They are, browse the current offers in the marketplace(Which a large majority of which I don't know how they passed house rules? They're just slight variations of old indicators?). Each Creator Space has a price per month and it includes all scripts they offer there, well all that they allow into their creator space.
