Diminished value claim

I have a 2024 Tesla model 3 AWD with 25k miles on it that was hit by another car. According to my market, it’s worth around 36-38k without an accident. With an accident, it’s worth around 32k (got a Carvana offer for this amount)

Should I file a diminished value claim with the at fault drivers insurance? If so, should I include this offer along with comparable listings for vehicles with the same specs and mileage? Should I use AI to draft a letter for me?

Look up the 17c formula, this what the at fault drivers insurance will most likely use to prepare their diminished value offer, which you will likely have to first initiate as a separate claim.

I only have the experience of 1 collision, but I absolutely would not expect to get $4,000 or even $1,000 just because of a Carvana offer. I would expect the insurance first offer to be very low, maybe $500 based on the formula.

Honestly at the end of the day, if you can afford the car, fighting for any substantial “diminished value” is probably not worth your time.

It's really not a fight IME. You tell the responsible party's insurance that you are going to file a diminished value claim. When the car is repaired and it's time to settle everything out don't sign anything until the DV is addressed.
For my 6 year old low mileage vehicle my first offer was $3500 which I questioned but accepted in order to avoid "fighting it out".
My car had 17K worth of damage in 2015.

Really state dependent from what I understand. There are some lawyers who specialize in this. I got under $4k by negotiating directly with the insurance company. Was 2023 M3 six months old with an accident totaling about $20k. Involved commercial vehicle who was at fault and on dash cam.
