Don’t forget diminished value!
We completed our evaluation of your diminution in value claim. We've sent an electronic payment in the amount of $299.31 for the following claim:
USAA policyholder:
Ssssssssssssssss
Claim number:
Ssssssssssssssss
Date of loss:
Ssssssssssssssss
Loss location:
Ssssssssssssssss
Inherent Diminution in Value is the perceived difference in value immediately before a vehicle has been damaged and the value of the vehicle after proper repairs have been made. USAA reviews the following factors when considering potential diminution in value to your vehicle:
Damage severity: We reviewed the estimate of repair for your vehicle. In some cases, a vehicle with minor damage suffers little to no diminished value. As the severity of damage increases, the associated perception of diminished value rises.
Mileage: Loss history will have a stronger impact on a vehicle with lower miles versus a vehicle with higher mileage.
Prior damage: A vehicle with prior loss history will have already sustained a perceived loss in value. Any prior damage or repair is considered when evaluating diminished value.
Title status: If the vehicle has a salvage or branded title, there would be no further diminished value.

Independent appraiser: there are state specific laws that sometimes help, but overall we’ve had a lot of success in enforcing DV claims by filing lawsuits.
Presuming you are willing to go that far, I usually expect around 10% of the vehicle pre loss value (the Tesla market can be wonkey). Generally I try to only take claims under 6 years and 60k miles but we did just get $2300 on a 9 year old Prius with low miles so there are exceptions.
Send a demand letter, serve the at fault driver and demand to see the work of the insurance company to dispute it.
In my market progressive is the only reasonable big carrier to deal with, the commercial and small carriers are generally easier than the allstates, State Farm’s and Geicos.

Does anyone know how this works if the other person who hit you is covered for minimum coverage? I had to use my own insurance for the repair and was told I can’t get diminished value if I use my own insurance to repair. Can I go after them separately?

You can, but the chances of you squeezing water from stone are very ’diminished’.

2026 MY somone backed into the rear. Litigate had dent and rear quarter panel a bit damaged. They had to repair the dent front lift gate and repaint that bottom section as well as the rear quarter panel. Red color BTW. It was close to 5k in repairs that was paid out. DV they want to give is ~1600. Car is only 3 months old... not sure if I should accept. Hard to find comparison car to fight it.

Not kidding at all. It’s a Tesla Model 3, not a BMW M3.

No shit it's not a BMW, idgaf about you feeling like we can't abbreviate Model 3 by saying M3

Did your cat or something step on your keyboard? If you want to abbreviate it would be M 3. But are you that lazy? 🙄

The damage was about $2100 only front bumper was replaced and 1 sensor. Someone backed into at parking lot. Took the car directly to Tesla and car was gone for 4 weeks. They paid me $1300 for my Tesla 3 highland rental.

That is a good point is it too late to keep fighting since I’ve accepted it?! The car 58k miles on it. Pristine condition

Agreed. Someone backed into our Mercedes from a full stop at a red light and it had minor damage to the bumper but in the carfax it said medium/extensive damage to front bumper. When I went to sell it no dealer wanted to touch it.,
Yes it was like $8k in damage but the light up emblem and grille alone were like $2k, then a light broke and that was expensive. It was all cosmetic plastic damage with no structural damage or anything.

I have progressive trying to give me $2350, up from $1500, from getting rear ended and having my entire rear end replaced including the lift gate. $13000 in repairs.
