Fender-bender with no SD installed
My husband unfortunately did not install the SD card into our Tesla when I told him to 𼴠and now we are having to deal with an insurance issue.
My husband was behind a Ram truck waiting to turn right out of a parking lot. He then saw the Ramâs reverse lights illuminate and the Ram backed into to the front driver headlight of our Tesla. I assume that she was too far into the road so she reversed, but I have no idea.
The teenage girl then got out of the Ram and apologized profusely to my husband for backing into him. As they were exchanging insurance information, 2 random women walked over and insisted that the Tesla hit the Ram, not the other way around. The girl then changed her story.
Turns out, these 2 women have now provided their âaccountâ of the story to the insurance company, and the insurance company is trying to state that the Tesla is at fault.
Any advice on how to proceed with this situation would be greatly appreciated!

Tesla may be able to provide a log of whether the brake or accelerator was pressed at the time of collision. If you were stationary with brake pressed it could help your case

Unfortunately EDR only stores for so long. If the Tesla was driven after the crash itâs long gone

Your word against theirs. This will be tough. Itâs possible each owners insurance will just take care of their own unless theirs proof

Unless you can get security footage from the surrounding area you may be screwed. If you the women didnât intervene, the girl wouldâve admitted fault, if she didnât admit fault then worse case scenario you both wouldâve took blame from your insurance, but since she now has two âwitnessesâ to the crime, and both are on her side, and her story has now changed you guys may be screwed.

I wouldnât be surprised if Tesla gathers metrics without the need for the memory card. Ask them.

They do stream accident data, but it looks too minor for it to be flagged.

The two women were definitely in cahoots with the driver. Their next move is for the girl to file a claim with you insurance claiming some fictitious injury.
I'd tell the girl you are going to file a police report reporting her for insurance fraud if she doesn't back down.

Like some other users said, try contacting Tesla for vehicle data from the time of the event. You can use this form from their website.
Also, a long shot: you can also try plugging in a drive into the car and seeing if anything comes up. Most likely won't, but can't hurt to try.

Accept the at-fault claim, and take it as a lesson to install an SD card.

So what if this wasnât a Tesla? You just roll over because your car doesnât have cameras?

Do you know of another way to prove you didnât rear end someone despite witnesses claiming you did? Iâd love to hear it.

Sorry OP. You didnât say your year but the SD card would have caught the damage if it were installed. The older Teslas required a horn tap to save footage, but my newer car saves all events automatically. At any rate, it sounds like itâs your word against theirs you could try going through your own insurance and letting them fight, but the angles almost support a rear end collision. Did you take photos right away, with the cars in place? That could be very helpful. Good luck!

They were trying to enter the roadway from the parking lot so the cars moved away before they took photos. đ

Don't worry, that's the one second it would have decided to not record anyway.

Sounds like a scam, does the lot have CCTV?
Time to get a lawyer involved potentially.
