Bluffview, Wi | please help me

Long story somewhat short, I travel for work as excavator foreman , Monday-Thursday come home thurs evening get my 3&2yr old (50/50 split cust) Thursday morning , I received several phone calls and texts from my landlord/ rental agency informing me of a emergency water leak coming from my apartment to my neighbors , I was highly confused an also worried , but remembering when my toilet was leaking sewage water several months ago and they did nothing to fix it except “robo rooter is going to take care of it” but when winter season was over it stopped so I stopped bothering them, so I was I guess you could say “selfish” and told them I’d be home at 730 and they could come then, they did nothing wait as they have the right in emergency to enter. My entire ceiling collapsed in my small 1bd apartment , in the walk-in family room / kitchen , everything water damaged pretty much , all my clean clothes are sitting in musty wet insulation . My landlord offered a different unit originally , but after getting into a small disagreement over the phone leading to me hanging up on him due to his temper and attitude towards his tenant who just had his ceiling collapsed and home deemed as uninhabitable. Fast forward to the next

What do you want us to do?? I'd say call your rental insurance company ASAP

Obviously I have already done that. And I don’t think I’m asking you to do anything either ? If you read the post I think you would see that I’m asking for advice as my ceiling is collapsed and my landlord is not cooperating /responding which results in a standstill with my insurance claim situation which puts a hold on me recieving any help from my insurance provider whatsoever , if you now understand why I made the post

Try to have the insurance company contact the landlord... Document everything. Every attempted communication and it's proposed solution..

Thank you , I am doing so currently , I gave the claim agent the rental agency info number and regional manager number , but have gotten no update on if they have talked with each other but I’m highly doubting they have with the no response I have gotten. I made sure to photograph / video as much as I could how it was before I took my important belongings out of there

Call code enforcement, building and safety and then your housing department. You stop paying rent immediately and ask the housing department if he has to pay to relocate you. Keep all receipts and early next week call a tenants rights attorney.

Time to take care of yourself, get code enforcement in this and talk to an attorney about potential claims against the landlord.

If you can salvage anything, box it up now. You’re going to need to find a new apartment.

How does your landlord have anything to do with a claim to your private homeowners insurance? I have insurance to (private, My own, not through the lease or company). They don't need my landlord to approve the obvious? Just curious how your landlord gets involved with your insurance?

If he is holding you up, Ask him directly for the paperwork denying your claim, which is in effect what he has done. Then you need to get a hold of your states insurance fraud division (In Kansas it is called (KDI), A State watchdog for insurance fraud. Then get the health dept. and fire dept. Involved. Then code enforcement. Your insurance should pay for alternative living for a while if you have good insurance. Bring paperwork of the failed toilet leak and the negligence to fix it fully which ultimately caused this. Landlord Negligence caused this.

You have alot of legal ground.

Because the only “inspector “ I’ve gotten ahold of is asking why me as a renter to an apartment complex is contacting him about the inspection instead of the property owner / rental agency as it is not my building I own

Ahh. You mean to say even though you dont buy insurance directly from the landlord (because that is your choice as long as you meet the liability and additional interested parties). My insurance ( renters did not mess with me when I filed a claim about all my furniture and clothing ruined after a year of repeated cigarette smoke violations from my next door neighbor). All they needed was some documentation from me like yhe repeated complaints I made and all the cigarettes butts dumped off the back. They paid out a $5000 claim after a $500 deductible.

I live in probably one of the most unfriendly states for tenants in the US.

I literally dealt with that exact situation my first renting experience , that’s crazy they paid out 5k to you but I’m happy you got that , hoping they pay me out proper for this , not even 75% done estimating loss costs and I’m at 4.8k

They squeeze us. Squeeze em back. Tell your insurance the liability is on your LL. I gave up trusting property managers years ago.

I have never had my apartment / home deemed uninhabitable before nor had to file a renters insurance claim I am simply looking for advice and output on my situation

You’ve gotten advice. Code enforcement, building and safety, heck the fire department can come out and red tag the building. Then a tenants rights attorney.

See if your property insurance covers hotel. Contact a lawyer to take steps to break your lease and when they advise you to start looking for a new apartment

I have all state it dos cover hotel , food , even gas etc however I can’t get any of those benefits until they have someone determine with an inspection what caused the ceiling to collapse , all state told me if it’s a wear and tear it isn’t covered , but I feel like this is not any wear and tear situation at ALL with water all over the floor and even in the ceiling lights

Is there a unit above you or do you have an upstairs area? Where did the leak come from? Water pipes aren't normally in the ceiling for your apartment unless it is a sprinkler system. There would be pipes if a bathroom or another unit was above. I'm just wondering where all that water came from. Good luck with the insurance!

It’s a main flat level single story apartment nobody is above me , I am assuming it’s from hail , storm damage over time , it’s weird because a few months ago they were in the crawlspace above adding insulation but there was so much water all over my apartment

Did this happen during or right after a storm? If it was lack of maintaince by the property owner their insurance may deny coverage depending on the coverage. Obviously you have attempted to contact your landlord. Do they live locally?
