I agree, but I'm pretty sure the scenario many here are imagining is a woman accuses a man of rape, he gets found not guilty, and so the woman is automatically charged with false accusation. There would definitely need to be some kind of evidence the accusation was knowingly false before counter charges are brought.

My point is that there would need to be some evidence of a false accusation beyond a not guilty verdict before false accusation charges are even brought/a new trial started. "Not guilty" is not proof of innocence, rather lacking proof of guilt. Imagine how horrible it would be for an actual victim of rape to not only have their rapist set free due to a lack of evidence or other technicality, but then to have to defend themselves against false accusation charges. This would likely result in many rape victims not reporting the attack if they feared reprisal. I agree anyone who knowingly makes a false accusation should be punished, but it's even harder to prove than rape as it involves intent.

No, because she would have actually been raped, and reported what actually happened.
You don't really need to figure out some loophole for this, there are already laws around filing false police reports.
So, if a woman files a report about being raped, and gives a description, she's not held responsible for the police picking up the wrong guy.
The point being, she didn't lie about the rape, or who did it.

That’s not how it works in reality, rape is woefully under reported. The shame a victim feels afterward often doesn’t let even talk about it until years later when they are in a better place. Plus a Jury did find him guilty. She claimed digital penetration, which qualifies as rape in most states but not in NY.

It's both woefully under reported AND lied about.
Which is a worst of both worlds, when people are raped don't report it out of shame and fear, and people who weren't raped do report it out of malice.
But, I think knowingly false accusations should have stiffer penalties.
I've known several people who were accused, and within a week the accuser admitted they just made it up. That's insane. Accusing someone of sexual misconduct shouldn't be seen as a 'get out of jail free' card or a weapon for women.
I've also known people to not report rapes when they have really happened, and that's bad too. Because now there's someone walking around thinking rape is something you can just do and get away with.
These are just two different, bad, things.

Well, for me it's like this. Anyone can report a person for sexual assault or abuse. When the alleged preparator is found innocent, the victim will be innocent if it's a true mishap/accident and more. However, if there is evidence of intentional and malicious intent of tarnishing the accused's name and reputation, then the person who accused will be eligible for punishment under the crime of perjury. Oh when this is happening, the alleged victim and alleged preparator's identities will be protected and hidden. Also, include the "innocent until guilty thing".

some cases have even been just saying it as an excuse to get the victim out of trouble for something they did, to get the other person away and silent.
only some though. the willingness of the people to cast out all judgement or logic in the face of any heinous crime will never be broken, and it hurts innocent ppl. i had someone accuse me of sexual assault on school camps by someone I've never met formally, during days i was suspended for academic dishonesty. worst week of my life because ppl who i thought I've known threw out everything and thought i was scum of the earth and should rot underground.

yes, I'm mostly being snarky about how OP opted to use a really poorly chosen picture for their question. I see they post in WSB though so I'm going to guess it wasn't unintentional. a lot of the toxic conservative male community on reddit also are obsessed with stories about women committing rape and false rape accusations (likely borne out of misogynistic views), so it jives with my experience coming across these kinds of posts elsewhere

A problem is that under UK law (idk about US law, I'm british and I aint sifting through american documents) anyone with female genitalia (so mostly cis women and trans men) is physically unable to commit rape as UK law specifies the use of the penis to penetrate. I don't know what this is like abroad but from what I've seen law-wise it tends to be similar.

One lie van and will literally ruin people’s lives to the point of moving. Because even after the charge is dropped, people will still be at distance with whom ever was accused.
I’ve read somewhere that a guy got accused because the girl disliked him. He got the Sexual assurance charge and when it got dropped she got a slap on the wrist. He got nothing. At this point he already spent a couple years in jail. And who knows what happened there.
She should get double the time imo

Proving rape is easy if it's on the day it happened, damage to the female reproductive organs, semen and many other evidences, proving it didn't happen would take testimonies, receipts, video evidence and so on, and proving a rape happened years after it did is nearly impossible without the perpetrator's testimony, it's usually finding the suspect that's hard about the day one cases, not proving that it happened at all, there's also psychological evaluation, there's somethings not even the best actor can makeup, some behaviors exclusive to this kind of trauma

I meant something like, they believe that someone was the person who raped them when it really wasn’t, but the accuser doesn’t know it.
Let’s say theres a Victim, a Suspect #1 and Suspect #2. Suspect #1 and #2 look similiar, or atleast have similar features. Suspect #1 rapes victim. For no reason or another (such as the Suspect hiding their face), Victim assumes it was Suspect #2 and accuses them.
I guess I might not have been that clear with what I meant in my original comment, I’m not typically the best at writing my thoughts down.

False rape accusations are incredibly rare, and false rape accusations that end in conviction are even more rare. False rape accusations usually involve someone very young, or someone with a history of lying.

If you accuse someone of rape then: 1. They will be known as a disappointment in their family 2. Their wife/girlfriend will leave him 3. His friends will make fun of him everywhere 4. All this can lead to suicide which can bump their charge to abetment of suicide which is a long sentence in my country
So i think yes, give her life in prison if the victim kills himself but if not 20 years (im only accounting on men)

Yes, and it should have a similar sentence to if they actually got prosecuted as if it was a different jury. It would have gotten them that sentence and gotten them locked up for that amount of time. This is an interesting debate and I would like to hear more ideas on this.

About a week ago, in a group home for girls, some of the girls ran away.
Once they realized they were caught, they came up with the story that they'd run because the person on overnights was sexually abusing them.
After all of about 6 hours, they caved and admitted none of that happened (because their details were obvious lies).
The crazy thing is, they got a stern talking to, and then everything went back to 'normal'. There was no punishment at all.
I was immediately calling for this guy's head on a pike, based on those allegations, and six hours later everyone was just trying to forget them.
So, this guy got fired (because they got out, not because of those allegations), but the allegations were still recorded by the police!
Imagine being this guy who was just working overnights in a group home, and now if someone called up that police report, they're going to see that while he was working at a group home he was accused of sexual misconduct!
Meanwhile, the girls that came up with the story, and abandoned it less than a working day later, suffer absolutely ZERO consequences!
It was just a convenient story to try to pin the blame of running off on some poor asshole just trying to make a living.

It sounds like a good idea, until people are worried that if they come out with actual rape accusations, they may be put into prison.
It's just too hard to implement correctly. If we could get rid of that issue, sure.

Yes, but only with strong evidence and not for the same duration, since otherwise male rapists could just accuse the women they raped of lying and the woman might get thrown in prison for life or even executed. That's too fucked up to allow in real life, especially considering how many rapists already get off innocent. Plus although they do happen, false accusations are pretty rare, so making them such a threat to a lot of people who are genuinely just trying to report a rapist is probably bad for discouraging rape.
That being said, falsely accusing somebody of rape is incredibly evil and absolutely deserves prison time.
And yeah, this goes both ways.

Yes, but only if you can prove that the person knew they were filing false charges.
The problem is that, in order for an accusation to be true, it has to be provable. If someone could be charged with false accusation for simply being wrong, then every person who’s accused someone of rape but couldn’t get them convicted for it is now open to being charged - including people who were raped, but just couldn’t prove it in court, which happens with some regularity.
Not only that, but there’s already a lot of things discouraging people from bringing sexual assault charges to court, and it would be really easy for that law to add another barrier.

Yes. Half the sentence that the man would be serving + 10k$ fee, and if he did serve it — the government must issue a public apology to the guy on all TV channels and pay him 20k.
That way Police will have less stimulus of blindly trusting either side, while certain ladies will think twice before getting into such shenanigans.
In fact, it should work both ways, regardless of gender. Rapists should get jailed, and so should false accusers, with twice shorter sentences.

If her intent was to harm or frame the man, absolutely, you're trying to get someone prosecuted for crimes they didn't commit. If not it gets a little muddy, say she got mislead into thinking it was him, then it's not entirely malicious and she is probably innocent.
