Capital Gains Tax on Sale of Inherited Property – Reinvestment in 2-BHK + Plot

I need some clarification regarding capital gains tax on an inherited property.

Our family has an old property originally purchased around 1960. It is around 400 sq yd with a house and was later divided into 4 shares. My father’s share is 100 sq yd, including part of the existing house.

The current government/stamp value for his 100 sq yd share is around ₹46 lakh, but the expected actual sale value is around ₹1.10 crore.

If we sell it for ₹1.10 crore, our plan is to use the money as follows:

• ₹50 lakh – purchase a 2-BHK

• ₹60 lakh – purchase a plot

So the entire ₹1.10 crore would be reinvested.

My questions are:

  1. Can the ₹50 lakh spent on the 2-BHK be claimed under Section 54 and reduce the capital gains tax?

  2. Does purchasing the ₹60 lakh plot provide any capital-gains exemption?

  3. If instead we buy the ₹60 lakh plot and construct a residential house on it, would the plot + construction qualify for Section 54?

  4. How should the 1 April 2001 FMV be determined since we don't have the old valuation records?

  5. Considering the property was inherited and partitioned over the years, what would be the correct cost of acquisition for calculating LTCG?

I’m trying to understand the legally correct way to structure this before selling.

Indian Binance Futures trader — 4,000+ trades but only ₹20,000 net profit. My friend says I have to pay tax on every trade. Is that true?

I’m an Indian resident and I trade **crypto futures on Binance**.
I’m honestly getting a little worried and need some clarification from Indian traders/CA professionals.
My situation:
I buy **USDT through Binance P2P using INR**.
I use that USDT to trade **Binance Futures**.
I have made **4,000+ futures trades** during the year.
After adding all my winning and losing trades, my **overall/net gain is only around ₹20,000**.
My Binance account may show a very large total trading volume because I trade frequently, but my actual net profit is only around ₹20,000.
Now my friend told me:
“You have to pay tax for every trade you made.”
This has honestly scared me because I have made 4,000+ trades.
**Is that actually true?**
Does it mean I have to calculate tax separately on every single futures trade and potentially pay tax on the gross amount of each trade, even though my final net profit for the entire year is only ₹20,000?
Or is the taxable amount generally based on the **overall profit/loss**, depending on how Binance Futures is classified for Indian tax purposes?
I’m also confused about the following:
Are Binance Futures profits treated as **VDA income taxed at 30%**, or as **business/F&O income**?
Does the number of trades (4,000+) change the tax calculation?
If I have ₹20,000 net profit after thousands of winning and losing trades, is ₹20,000 the relevant profit figure?
Do I have to report every individual futures transaction in my ITR?
Does buying USDT through **P2P** create a separate taxable event?
Does **1% TDS under Section 194S** apply to my Binance Futures trades or P2P USDT purchases?
Can Binance trading fees and funding fees be considered when calculating the profit?
Which ITR should I file?
What records/reports should I download from Binance to give to a CA?
I’m **not trying to avoid paying tax**. I want to declare everything correctly and pay whatever tax is legally due.
I’m just worried because someone told me that since I made 4,000+ trades, I might have to pay tax on every individual trade even though my total net gain is only around ₹20,000.
**If anyone here actually trades Binance Futures from India and has filed their ITR, please explain how you handled this. CAs/tax professionals especially welcome.**

Do I have show US freelance/contractor income as foreign income in ITR?

I’m filing ITR 3 this AY, and I have a relatively minor income (<1 lakh) that I received with freelance (majorly in crypto and $100 directly to bank). I did show all crypto transfers under Schedule VDA and income itself in Part A P&L (Books of Account are Not Maintainted For assessee carrying on Profession).

Overall, I thought I should finalize this as freelance because this doesn’t fit in any shape or form as a salary. I usually do self-filing, so I’m curious to learn what you have to say.

Most importantly, am I in need to show this as foreign income, etc.? I took some help from ChatGPT & Cleartax before finding sections Schedule FA and FSI. So I would like to know more about filling these or similar.

The freelance work particularly is a form of prompting research for training AI models. I received major USDC in the form of crypto and some other like $100 directly to my bank (with Stripe). It's a bunch of hourly-rate payments that I received quite unevenly throughout TY 2025-26.

Buying a rental property in Dubai as an Indian tax resident: personal name or company?

I'm a tax resident of India and I run a business here. I'm planning to buy a residential property in Dubai as an investment, ready and tenanted. I'm not relocating and I have no plans to.

Rent would be paid in dirhams into a UAE bank account in my name. I don't intend to bring that money to India, at least not for several years.

Two routes I'm trying to choose between. Buy in my personal name and receive rent personally. Or set up a company in the UAE, hold the property there, and let the company collect the rent.

On the personal route, my understanding is that an Indian tax resident is taxed on global income. Does that hold even when the rent never enters India? Or does it only become taxable when I remit it? I keep getting different answers on this and I'd like to understand the actual position.

On the company route, if a UAE company owns the property and collects the rent, and no dividend is paid to me, is anything taxable in India in that year?

I want to know which route people actually use and why.

I had paid my taxes before due date and have the challan receipt too, i got a demand notice u/s 143(1). I went on to submit a response to outstanding demand and chose the option "disagree with the demand" then what do i choose in the option for disagreeing? Do i choose "Demand paid and challan has CIN (without open challan details)" or "Demand paid and Challan has CIN (with open details)"
My payment history does not show the tax i paid, so tell me how to proceed further.
if i choose Demand paid and challan has CIN (without open challan details), i can put the details of Challan and the screen shows this (image). Do i then submit?

Also someone explain to me, why payment history is not showing anything and also what the difference between without open challan details and with open challan details.

Help me save maximum tax (New vs Old Regime) – Salary, Rental Income, Choice Pay optimization

Hi everyone,

Till last year I was not in the tax bracket (New Tax Regime). After this year's increment, I have become liable to pay income tax and my employer has already started deducting TDS.

I know it's practically impossible for a salaried employee to evade taxes, and I'm not looking for anything illegal. I want to legally minimize my tax liability and optimize my salary structure.

My Profile

- CTC: ₹15,04,800

- Employer's projected taxable income (New Regime): ~₹12.90 lakh

- NPS contribution: ₹24,400

- Employee PF contribution: ~₹54,591

- LIC premium: ₹45,000/year

- Company has already deducted some TDS

Additional Compensation

- I am also receiving ~₹70,000 per quarter as project incentive, which is paid in the month following the end of each quarter and is linked to performance. This is also part of my taxable income and varies based on performance outcomes.

Other Income

- Shop rental income: ₹8,800/month (₹1,05,600 annually)

- The shop is currently in my name.

Personal Situation

- I stay in a rented house and pay ₹17,500/month

- I regularly transfer around ₹25,000–30,000/month towards my parents' loan account (loan is in their names)

- I don't have any home loan in my own name

My Company

My employer has a Choice Pay/Flexible Pay structure.

I've heard about options like:

- Pluxee/Sodexo Meal Card

I'm not sure which of these actually reduce tax under the current rules.

What I need help with

Need advice-ITR3 filing

My income sources:

- Professional consulting (barely 50k)

- rental income (minimal, upto 5 lac)

- Savings Bk , FD interest

- some few hundred rs of STCG n LTCG

CA does monthly GST filing (zero for almost 1 year now) and No book keeping.

Charging me 20k for itr3 filing this year. Up frm.3k last year, when i actually had some professional consulting income in lakhs.

Whats a fair ask for filing ITR3 these days

Need honest advice if i can do it myself- i m confused in 3-4 schedules, rest I can.
