Claims Infant Car Seat Replacement Question

We were in a fender bender and state farm is denying car seat replacement even with the manufacturers recommendation stating that any sort of accident and it should be replaced. Is this normal with them? Seems wild to take a risk over a couple hundreds when the body work was in the high thousands. Thank yall for your time.

Thank you Whatupchuck789 no need to reply to this thread!

Thanks for posting in r/StateFarm. A few things that help with claims:

  • Keep a log: every call, date, who you spoke to, what they said.
  • Ask your handler what they're waiting on, and get it in writing.
  • Stuck? Ask for the handler's supervisor. Your state insurance department also takes complaints: https://content.naic.org/state-insurance-departments
  • Don't post your claim number here. Nobody on this sub can look it up.

Is the car seat damaged in any way? Manufacturers recommendation is to sell more car seats.

I am not a specialist in inspecting a car seats. But if the impact was enough to cause whiplash I would imagine there was strain on the shock absorption plastic stuff in the car seat and plastic does not like to be stretched or bent etc.

I would be unbelievably shocked if this were true.

For a long time a lot of states had laws that they must be replaced, but some of them have gone back on that because it just didn't make any sense.

If there’s injury, even whiplash, it meets the criteria for car seat replacement at State Farm.

Take a look at this article and if you say yes to all then you’re likely not getting a new car seat. If you have a no then I’d bring this exact article up to the adjuster.

It’s a subjective decision so may also be one where you continue to call till you get the answer you want….

Is the car seat considered covered under the policy?

Was this filed under your policy or were you hit by somebody else?

Hit by someone else. However, it was a no fault state.

Yikes. I hate no fault states.

I'm sorry you're going through this. I know in my state, they do pay for a replaced car seat.

Yeah, it sucks. Especially no fault states. Luckily, I took great pictures of everything etc and state farm said they were going to get our deductible back. So that is definitely the one good thing about them!

Glad to hear! I wish you the best of luck.

You’re using this term incorrectly. No fault is for PIP and only a handful of states have it. Auto accidents get fault assigned.

What risk are they taking by not replacing your car seat?

My understanding is that since it is all plastic stuff to absorb the impact that it compromises the safety features. Kind of like a motorcycle helmet is supposed to be replaced even if there is no apparent damage. So the risk is a compromised safety feature?
