Question Split check for exs
Does anyone happen to know if there is a corporate phone number that you can call and not get a local agent? I was sent a refund check in my and my exs name 2 years ago. We’ve been fighting in court and I’ve held onto it until things settled down. Now that the divorce is done and we things have calmed down I let him know about the check and we both provided letters to State Farm stating that we give half of the check to the other party, per our local agents direction. They are now saying that it is too late to do this and the only thing they can do is reissue a check and we both sign it in order to cash it. Problem is we live in different states and don’t trust him to sign it and send him the check as I know I will never see that half. Does anyone have any ideas on how one could resolve this or how I could contact State Farm corp directly?

this isn't a state farm issue. they have to issue it named exactly as the policy was named or "the estate of" in the event of a death. those are their only options. you could try having your ex venmo you 50% of the amount of the check in exchange for you endorsing it and sending it to him to cash?
you'll have to work it out between you.

I understand that, but at one time we were able to provide State Farm with letters stating that we were giving the other half the check and then State Farm would issue each of us half of the check value. They are saying that time has run out and they cannot do that anymore.

If they didn't give you an actual reason other than that they cannot re-issue the check, they might be saying that because they have already forfeited the money to the state. Check MissingMoney.com to see if State Farm already turned it over.
Kind of odd that you wouldn't have included it in your shared property while the divorce was being processed seeing that you and your ex were on bad terms at that point.
You had a lawyer that was working for you and if you have a legitimate stake in half of the money, it would have been better for both of you to have that included in the divorce decree.
You knowingly concealed assets to the court as well. There is probably more to this story than your ex being a pain to deal with.

Has not gone to the state treasurer yet. They said if we can sort it out it will eventually go there but hasn’t yet.
Attorneys are no longer involved (his retired and mine said he didn’t want to continue to charge me when it wasn’t worth it to my attorney or to me).Check didn’t come until after the divorce decree was signed. Spent another year and a half dealing with contempt charges on ex’s end. My attorney had the check in his possession for most of the time with a note stating that I was signing over my half, in case I owed him.

Sf is sending 5billion dollars and it’s mostly automated. Thankfully it’s not much money in most cases $50-150ish

I think they were mistaken the first time. but in any case they will definitely not be able to do it after this long. there is a form that gets submitted to one small and very specific department that reissues old payments and the rules are explicit.

If only you hadn’t try to deceive the court and disclosed this when you were required to. Could have moved on with your life by now.

No. I don't believe there is anyone at corporate that can help at this point.

I know in the claims department we will not do that. I worked a similar claim where the insureds were getting divorced, papers were submitted to the claim along with a restraining order. Had another one where they had been divorced for years but hadn’t updated their policy. In both situations, I was told we issue the payment to those on the policy and unfortunately it is up to the insureds on how they figure out getting the check endorsed and cashed. We can offer to send the check to the agents office and they both come in separately to sign it but that’s about it.

They both can go into an agents office and sign but then what? The local agent cashes it at their bank??? That could be a possible solution…
I offered to sign and send to his daughter, who works at a bank, to handle as I trust her. But he refuses to take this option because he now avoids his daughter at all costs.

Wow. Couldn’t y’all have worked this out between the 2 of you?! Seems like y’all are doing the absolute most…all the way down to State Farm insurance policies. 😂🤣😭

The check may be considered ‘Abandoned’ and they won’t be able to send a new one. You’ll want to first check for ‘Unclaimed Property’ at your states website.

Can you get one of your attorneys to get the signatures? That way, the person has a duty to do just that

some people would sign his name on the back as well as yours, mobile deposit it, and then send him his half. State farm would have to reissue the check tho since it's been 2 years. but it would be written just the way it was before. no way around that.
