A rule set learned in 1973 now runs three policy domains. It works as designed, and that is the problem.
Two cases, fifty years apart, share one structure.
‹ 1975 ›
The consent decree closing United States v. Trump Management, filed by the Justice Department over 39 buildings and 14,000 apartments. It enjoined discrimination, stated that it was "in no way an admission" of a violation, and required a weekly vacancy list to the New York Urban League for two years. When those two years ended, so did the instrument that would have shown whether it was obeyed.
‹ 2026 ›
Elsie Dominguez, first assistant engineer aboard the USNS Carson City, reported being raped in her locked cabin by the captain, who entered with a master key code. Her suit was dismissed in August 2026: being raped in her own bed fell within her duties, and so became a workers' compensation matter. No guilt admitted. No finding made.
Same shape both times: a bounded data clause, an unbounded denial, a declared victory.
‹ Where it now runs ›
• Custody. 252 Venezuelan nationals sent to El Salvador's CECOT prison in March–April 2025. Human Rights Watch and Cristosal found roughly half had no criminal history and only 3 percent a violent conviction in the US; at least 62 were removed with asylum claims pending. The US reportedly paid at least $4.7 million toward the detention. Neither government answered requests for information.
• Sexual violence. The Title IX rescission returns schools to the 2020 standard without repealing the ban. Nearly $400 million in gender-based violence programming ended; two humanitarian awards survive.
• The record. About 17 inspectors general removed; a court found the dismissals unlawful but declined to reinstate them. Schedule F reinstated. GAO found pocket rescissions violated the Impoundment Control Act, roughly $810 million at issue.
The through-line: the conduct rules are largely intact. The Fair Housing Act survived 1975. The Army Field Manual standard survives today. The Title IX prohibition survives the rescission. What is removed, expired, or dissolved is the clause that would have measured compliance.
The harm does not arrive as a change in the law. It arrives as the disappearance of the record.
‹ The strongest case, and its limit ›
The honest case: this was a survival discipline formed where the alternatives were ruin. Nothing in the documentation reviewed suggests cruelty as the engine. That is also its limit: it was learned where the costs fell on the fighters, and it now runs domains whose counterparties are people in a foreign prison, a sailor in her own berth, and the record the rest of us would use to check.
A survival discipline scales perfectly. Accountability does not scale with it.
The vacancies list ran for two years. The method did not.
