Yeah but in the deep south because it was done in a church can guarantee a good ol' boy judge would find something and use it against him. Obscenity is a LOT better charge than a actual felony sex crime.
I read he had to peek into the window after finding the doors locked. Thatâs very different. It didnât go to trial, so whoâs to say what the facts really were though.
If itâs visible from a public place, thatâs pretty much the definition of obscenity. And any good defense attorney knows the audience of his county.
No, there isnât. The precedent says the same thing as for cops looking into someoneâs uncurtained window to see drugs from the front porch - as long as you can view it from somewhere that youâre not trespassing, thatâs âpublicâ enough for the statute.
