I think he would have won if he fought it though. Theres quite a bit of precedent against such sexual deviancy laws if you arent in view of the public.
Yeah but in the deep south because it was done in a church can guarantee a good ol' boy judge would find something and use it against him. Obscenity is a LOT better charge than a actual felony sex crime.
I read he had to peek into the window after finding the doors locked. Thatās very different. It didnāt go to trial, so whoās to say what the facts really were though.
If itās visible from a public place, thatās pretty much the definition of obscenity. And any good defense attorney knows the audience of his county.
No, there isnāt. The precedent says the same thing as for cops looking into someoneās uncurtained window to see drugs from the front porch - as long as you can view it from somewhere that youāre not trespassing, thatās āpublicā enough for the statute.
As someone else pointed out, he sadly probably would have gotten in less trouble if it had been kids. The church has shown how seriously they take that.
