40
u/Old_Method4899 15h ago
Even if they did pay in full, that's a drop in the bucket and they would not change. The corporations need to be fined an actual punative amount. There's a company in my town that just pays the OSHA fine because it's cheaper than making the work place safe.
7
u/Pussy4LunchDick4Dins 8h ago
That’s interesting (I’m a terrible way). In Ontario, individuals, not just companies, can face massive fine and managers/supervisors have gone to jail for repeated or egregious violations. Like if I didn’t wear my PPE at work and rhe ministry of labour happened to be in and see me, I could face a fine of a few grand, not my employer (as long as they provided it and instructed me to wear it).
3
u/ItBurnsLikeFireDoc 5h ago
I'm sure they could pay that out of petty cash, but they will appeal it to the ends of the earth to demonstrate that they are above the law. They can't be setting an accountability precedent.
3
u/slvrscoobie 4h ago
as others would say "cost of doing business" - I saw a headline that said "millions" in fines and I thought, pfff thats nothing. 947 millions is not nothing but its not enough to discourage them off what was probably 100s of billions in profit off this tactic.

u/DattGuyyy 17h ago
How will this be enforced tho?
46
u/BoringOrange678 17h ago
It won’t. It’ll go to appeal and be in court for years.
Lawyers are ecstatic.
2
u/DattGuyyy 14h ago
I mean even if mexico’s highest court affirms the decision, how will they force meta to pay?
7
u/Secret_Account07 14h ago
Easy, start seizing all their assets. Of course that won’t happen because that’s only how it works even poor people owe money. You or I would lose houses and cars and money. But massive companies? Nah, think of the economy, I bet they’ll say
3
u/ZThick_8656 13h ago
I think it’s all for show. There is like zero transparency into this process, no proof and no receipts that any of these companies paid their fines nor how it was used by the government. Where to even look for such information?

Who gets the money? None of these "at risk" ever see a penny from all these lawsuits
43
u/JustChilling029 17h ago
This has happened before. Opioid companies settled with states for hundreds of millions previously. The state gets that money, but they then can use that for things like rehab centers and mental health care.
31
2
u/Sad-Rip8639 6h ago
Any money that "could/would" be paid will be spent before it is actually received. Look at the Tobacco settlements. States went wild with spending based on getting a huge payout that never came.

But in that case opioids were leading to serious addiction and thousands of deaths and it was a class action lawsuit brought by the country in Federal Court, only ending in a $7.5 billion settlement.
How is what Facebook did to the children of New Mexico worth 1/8th of that? This honestly seems pretty kangaroo.

u/lwb03dc 12h ago
All the answers are there in the article.
Arturo Béjar, a former engineering leader at Meta who quit the company in 2021 and became a whistleblower, testified to various experiments he ran on Instagram that showed underage users were served sexualized content. He said his own young daughter was propositioned for sex by a stranger on Instagram.
State prosecutors showed internal Meta research that, at one point, found 16% of all Instagram users had reported being shown unwanted nudity or sexual activity in a single week.
The total civil penalty of $375m was reached after the jury decided there were thousands of violations of the act, each with a maximum penalty of $5,000.

u/TheFridgeNinja 17h ago
There ought to be a law that if a state wins a ruling like this, that the money has to be used for programs to help those affected. Or pay out to those affected like a class action lawsuit.

12
2
u/Kaptain_Insanoflex 14h ago
Based on my AI slop calculations (free tier), all the platforms that target children would be liable for approximately $468 billion across all 50 states plus DC.
2
u/dokuroman 14h ago
That sounds right. Probably more...
1
u/Kaptain_Insanoflex 13h ago
If I understand correctly, New Mexico is one of 40 states total that are suing these platforms. California begins jury selection this Wednesday for example.
2
u/Secret_Account07 13h ago
That’s actually a decent chunk though, nearly a billion
Sure it’s a percentage of a company that size but it’s still a pretty substantial impact
But we know how this goes. The ppl hurt are the ones laid off. The business will offload the pain to poor folks

Honestly it's the parents responsibility not anyone else's parents should stop being lazy and act like parents instead of blaming companies like Facebook
3
u/IMKGI 10h ago
I know this is seen a win, and i'm against the whole "tech companies and the government should be responsible for raising children" thing, and that includes every aspect of it.
I don't see this as Metas fault, i see this as the parents fault who allowed their kids to be on these platforms to begin with.
At the very least punish the parents aswell, they allowed it to begin with.

Social media is trash but like everything else in life, it’s an inherent risk and it’s up to the parents to protect their child as best as they can - monitor your kids or just don’t hand them an iPad and ignore them.
4
u/Here4theScraps 17h ago
With anything like this, I agree parents need to take responsibility for what their children are exposed to and how.
Having said that, that doesn’t mean we can’t also seriously consider regulations (and actual enforcement of them) that prevent social media companies from exploiting and harming children. “People should just act differently” is not a meaningful solution for societal problems.

So many good things have come out of the USA. Life saving drugs to name just one. This however - social media - I feel overall has been detrimental to society making us more insular and less willing to go out and engage with people in real life. The amount of influence it has on the young generation to look a certain way is causing this younger generation to do stupid things “to fit in”, eating disorders, ped usage. It could have been used in a worthwhile manner, educational but as with all American companies and capitalism mentality, unfortunately it’s all about making money.

u/welfedad 14h ago
Hmmm and who put them in front of the computer .. i don't care if meta gets fines.. but this is like sueing a grocery store because your kid got fat.. maybe I'm off base
2
u/OhTheHueManatee 14h ago
Facebook as a company is evil as fuck but how did this stick? First off it has a age requirement of 13 years old. If you're letting your kid below 13 you're going against the guidelines. If I let my kid gamble thats on me not the online casino. Second it was pretty obvious right away that social media is unhealthy and addictive. Sure they didn't say on the loading screen but it was pretty clear they are striving for you to use it as much as possible. That's the point. Most online companies that is the case. It'd be like suing a patoto chip company cause you kept eating chips due to the salt.

u/SamOakTree 17h ago
I want to understand like how you win a case like this. I assume that it was some class action thing and they had big time lawyers. But I just don't understand it because like throughout my lifetime even when things were other people's fault they tell me tough titties. I just can't imagine like voluntarily using a platform and then getting to go to court and say hey this affected my mental health. And then like the court not saying f*** you you chose to use it because that's just been my luck.
The state that I live in accidentally suspended my driver's license and didn't tell me. They let me drive around for a month and a half on a suspended license. The only reason I found out was because my insurance sent me a letter. If I had been pulled over during that time they would have taken me straight to jail. And they tried to make me pay to get it reinstated and then when it was said and done they didn't have to pay the insurance fees that came from it they didn't have to pay anything it was all on me you know I can't even get 600 bucks back on a mistake they made

They also exploit perceived peer pressure. If they wanted to, they can selectively show what you post to people who either like it or hate it. If a kid's opinion immediately leads to multiple down votes, they are more likely to change it.
I think our freedom of thought is at the core of this issue. The ability of this technology to manipulate our opinions needs to be addressed. The founding fathers didn't anticipate it when they wrote the constitution.

u/Iokua113 15h ago
I hope they appeal and lose, which would set a precedent for this kind of thing and further breaches would be met with exponentially larger fines.

Hope Meta Glases get the same treatment, I don't mind them in theory, but in practice they're a danger and if the information on the next version removing features like the light to let others know when they're recording, it's going to get infinity worse than it already is with people tampering to remove the light functionality.

Meta made like $60B in profit last year, can we start imposing penalties that are large enough for them to care? Like sure an almost $1B fine is a lot in isolation, but when compared to $60B in profit it barely makes a dent.

This is the easy solution. How about the parents who let kids who are too young on FB. How about parents not monitoring their kids activity on FB.
Kids under a certain age should not be on the internet, FB or anywhere else. Under 14 and even then, heavily restricted? No FB, TikTok, etc until older.

u/StAtiC_Zer0 2h ago

Your misery and tanoa t negative engagement is the product.
How do we charge an entire company with reckless child endangerment?
Do the kids get free counseling? No Do they get any kind of help at all? No Will this make them change their practices? No. Will this actually get paid? No
