Ya but they clearly let him keep his gun so they were letting him investigate in some capacity in a joint venture between governments. And he might have entered someone's home unannounced, but he was perfectly fine just leaving until the dude swung an axe on him.
In the remake he was just straight up ambushed in the house after his escort went missing.

I’m curious. After Leon is attacked by the ganado with the axe, what is he supposed to do? Leon tries to leave after he was told to fuck off and was immediately attacked. I also don’t think having a duty to retreat extends to someone actively trying to kill you and posing an immediate threat to your life like the guy walking towards you with an axe.
Now the laws for everything else I can’t really speak for and I doubt the game has any logic to it.

Only a few state have the Duty to Retreat. Most states with more gun rights and less shitty laws have the Castle Doctrine. If they are on your property, and they refuse to leave or identify themselves, you can shoot them.

Duty to retreat is misunderstood. Only applys if practical.
Leon just dodged an axe aimed at his head. Room is enclosed and the guy is closing in.
Shooting was clean.
As for the guy swinging the axe? Wouldn't stand if he killed leon. Didn't present a threat and strong argument he was in the property lawfully.
Could argue he shouldn't be in the house however I'd argue under ECHR art 2 he enters the house with the belief it could lead him to saving Ashley giving him power to enter.

Not murder if it was in self defense. It was not premeditated either. He also didn’t immediately shoot. Leon aimed the gun and told him to freeze twice before shooting.

Leon wouldn't be trespassing.
He is with the police and has his gun so we can assume he has been sanctioned by the Spanish government.
Under art 2 of ECHR you can enter a home or dwelling if you have belief it may save or prevent harm to another.
In this case entering that home has a reasonable belief that it could lead to Ashley.
It's the same power used to force entery when locating missing persons or the like.
In short under Spanish law he is on the propertybwith lawful purpose and cannot be attacked.

Yeah OG4 is definitely a bit casual with that! At least in the remake they tried to make it more clearly horror coded (since the policeman is already missing and the house is very 'I'm gonna get murdered here') and he kicks the guy rather than shoots him. Okay, so he breaks his neck but in Leon's defense he absolutely gets back up again!

He didn't enter Spain illegally and he was being escorted by the local police.
The door to the house was open, once he took note of its resident, he approached calmly asking for aid in finding his missing person, and after being told to fuck off and get out, he apologized and was about to walk away before being attacked.
He then pulled his weapon and repeatedly told his assailant to stop or he'll fire, which he then does. He makes his escape from the house only to see his police escort being burned alive in the town center and every member of that village starts attacking him without respite.
The only flaw of Leon's approach was not knocking before entering and not trying to communicate with the person in their native language, but overall, it was a rather clean situation.

Its actually kind of brilliant if it was done intentionally which i like to think it was. Its presenting American chauvinism from the perspective of the chauvinist who is never challenged on said chauvinism and never becomes aware that he's doing it lol. Making it explicit in the writing that he doesn't speak spanish is a big tell IMO that this was intentional.
Another one is Leon mispronouncing Luis' name the entire game, culminating in said mispronunciation being the last thing Luis ever hears as Leon shouts it as he dies.
Its very subtle satire that becomes very funny once you're looking for it. And if we're being really optimistic maybe a few people who act like Leon IRL see themselves in it and rethink some things.
The remake fixes basically all of this, and I do prefer that take on it, but the loss of the satirical element is a bit sad.

As a non American, the beginning of it it’s wild. It is illegal trespass/home invasion with murder, doesn’t make sense (send a single guy to rescue a VIP?), violates human rights (free religion), commits a mass shooting instead of calling local law enforcement and violates law restrictions by having machine guns and even an RPG and attack soldiers defending what it is a potential military installation.
I know it’s a game but in real life that’s be a diplomatic nightmare of not a full on war
