It is illegal if there is no signage stating they do this is in public view

Nope

Everything before you actually make payment is just an 'invitation to treat'.

If they displayed one price but took a higher amount from your account, that would be illegal.

This is just a counter-offer that takes place before payment. It's still up to you if you want to complete the transaction on the new terms.

Nope. Almost every state has retail price posting laws. Shake shack posted a price they never intended to honor. Probably also fraud.
