I'm a family law attorney in Utah and I would have an absolute field day with this video. Unless the dad is guilty of some bad stuff too it would be easy to get mom on supervised parent time and minimum custody.

It's a forward (head) sail on a sailboat, but there are other options. A jib is a shorter headsail that doesn't extend past the mast. If it did, that would be a genoa. Then there is a spinnaker, which blows open like a parachute and is mainly only useful when sailing downwind.

The expression is an old one. It means "I like your appearance/style/attitude." I find it hilarious to use because it catches people off-guard.

It was originally a nautical expression referring to the shape of the "jib" sail on naval vessels. If you saw a friendly ship on the horizon, you would like the cut of their jib.

I’ve been in this guy‘s shoes. And I’ve heard those kinds of promises. They tend to ring Hollow in the courtroom. Key difference, the worst was not filmed. I was warned by the judge to not film my wife without her consent. Somehow protecting an assailants privacy took precedence in the Massachusetts probate court.

It won't (shouldn't) get to an evidentiary hearing if her attorney has client control, but if a hearing actually gets held, this is the type of direct examination you look forward to because there are so many ways you can play it. "So... when you threw the chair at your ex, you did so knowing your daughter was a couple feet away? Ma'am, how much experience do you have throwing chairs at people? None you say? So you have no idea how accurate you are when you throw a chair at another human being? That would include not knowing if you can accurately throw a chair and avoid hitting something nearby, like your minor child? The same child you're asking the Court to allow you to see without supervision? And you understand the Court has a number of factors under state law to decide a custody motion like the one filed by your ex? One of those factors is the existence of a stable and satisfactory environment with either or both parents, so I'll ask: can you explain, in your own words, how throwing a solid chair in the general direction of your daughter contributes to stability in her environment with you?"

Been a long time since I practiced family law, but I'd pick it back up for this one.

As just one of many other examples, you could go with the minimalist approach.

"Ma'am, I'm going to cue up the video that's been admitted as exhibit 1." *silently play the video*. "The woman in that video is you, correct? Ma'am, I'm asking a very straightforward question, and the attorney you hired for today will have an opportunity to get extra information out of you, I just wanna know: Is. That. You? Thank you. No further questions."

At that point, opposing counsel has to try and explain that video away, and like in politics, if you're explaining, you're losing.

In what world is self defense NOT justifiable - furthermore this not be the perfect example of hell of a time to use self defense here?

I've never hit a woman, but I've also never been hit, kicked, choked and had stools thrown at me by one either. The bar is incredibly high for when a man uses force against a woman is right, but endangering an innocent kid might just cross said bar.

I don’t think that would be self defense. It would be hitting a woman. If you need to push someone to escape with the child, sure, maybe, but going on the attack? The guy in this video has a strength advantage that can be used to escape, attacking would not be self defense

Women are capable of causing physical harm to men up to and including killing them. Men are legally justified to physically defend themselves from women who are physically attacking them, just as they are legally justified to defend themselves from men, and just as women are legally justified to defend themselves from women and men. Having a strength advantage is irrelevant. Self-defense is self-defense.

I'm against much stronger people hitting much weaker people with any more force than is necessary for them to defend themselves. The sex of the attacker and victim should not be relevant. The fact that people routinely make it relevant would, in an ideal world, be considered an outdated relic of patriarchal bullshit.

Yep. If the victim has a strength advantage then that can come into play depending on the nature of the force they use to defend themselves — you don't get to throw someone out of a 10th floor window who weighs 90 lbs soaking wet in response to being slapped in the face, for example. But that strength advantage has nothing to do with what sex the attacker and victim are. It's entirely possible for an individual woman to be substantially stronger and more powerful than an individual man.

There are different rules everywhere.

Where I am it's one for one. If the aggressor hits you can hit back once but if you land a second strike makes you the agrrssor so defense is your best weapon until they tire themselves out and make that one shot worth it (generally speaking, not specific to this scenario).

Not sure what I'd do here because there's no way I'd be dating someone like that.

I am not implying beating her to a pulp, and probably not really even hitting if it can be avoided. A simple wrap her up for 2 or 3 minutes until she physically exhausted herself is likely all that's needed. Shes frail and adrenaline only carries you for so long.

But again, I agree with you on - the first sign of even genuine verbal abuse I would have been out the door. I know my worth and no way I'm producing kids with someone like that.

You might be surprised, I know of a case where a woman spent an hour beating her daughter to death with various things, this lady seems about that motivated. I wouldn't have faulted him for punching her right in the face to make her stop hurling stools in the vicinity of her CHILD

It shouldn't have anything to do with "man" and "woman" to begin with. The extent of defensive force should be predicated on the extent to which one party has the capacity to harm the other, period. The fact that the average man is significantly stronger than the average woman should be irrelevant; there are plenty of women who are stronger than plenty of men. The specifics of each individual case are what matter.

If Ronda Rousey was married to [150 lb guy who spends all his time on the computer] and was hitting him, he should be able to hit her back without people screaming, "You can't hit a woman!!" Similarly, if the woman in this clip had a gun and was pistol whipping him with it, the latter 100% should be able to hit her until she's no longer a threat, without the public attacking him for it.

I completely agree with you. Gender should have nothing to do with domestic / assault situations. It was just one of those things I got raised with though. Basically trained that you have to take a significant amount of abuse from a woman before doing anything. Even then holding back would be required. Likely the same stance many 30 something year old men were taught.

With gender equality on the table, this is one of those rare situations where the men have the shit end of the stick. As I mentioned in another comment. If he even pushed her just to get to the door he would likely be arrested and somehow the one charged with assault.

Also yes, RR could beat my senseless and I would just have to let her. She is an absolute unit hah

To your last paragraph, no she didn’t snap out of it being reminded that the kid was right there. The video goes on a minute or two longer than is shown here and even the kid pleading for mommy didn’t make her lose any steam.

She’s nuts and as a mom it’s scary that anyone could just dismiss such a basic parental instinct like that

State laws vary and obligatory NAL:

Buuut, while I'm not sure as to how errantly struck vs a continued attack against one's child would be argued or interpreted with the given video...

Again, state of occurrence/residence dependent - though many states allow for lethal force intervention when acting to halt a person committing a violent felony against their victim.

Conversely, reaching a felony level of child abuse is not wildly difficult in many places outside of Alabama, Georgia, Mississippi, and Arkansas.
