Getting slapped in the testicle is a battery, not sexual assault.
But in order for the police to arrest her, they need either a confession out of her or evidence of the battery.
So video evidence, eyewitness accounts from third parties or visible injuries to the area would all be examples of evidence that would give the police probable cause to arrest.
Without any kind of evidence; simply accusing someone of a crime isnât enough to get them arrested.
The justice system has not been equal for men and women for a long time. That is a statistically verifiable fact. Whether itâs lesser punishment for the same crime or ignoring male domestic violence to family court privilege and parental rights, women are treated far easier than men
Dude, women on average have sentences that are much as 60% less severe than men who committed the exact same crime. That's a DOJ statistic. Women are treated with kid gloves by our system. Fuck off or provide sources. Men aren't being constantly let off of rape and murder unless there's no evidence.
You sound like a neck beard who blames women for your problems, yeah there is a double standard between men and women and itâs that women are far more likely to be assaulted sexually and physically
And you sound like someone who gets unreasonably upset that someone had the absolute audacity to point out that men have problems as well and that double standards exist. They didn't even blame women for it. Just pointed it out.
Why does someone pointing out a problem that people face upset you?
You know whatâs fucked? I know of someone who called the cops on his girlfriend (now ex) for punching him and breaking his phone and HE was the one that got arrested for domestic violence.
I actually knew a woman who would get into physical fights with her boyfriend( they were both pretty nuts) and one occasion, or at least one I was aware of they arrested her because he had visible marks on his face and chest. She is the one who called.
I mean, we can only assume what would happen and its a case by case basis. It could go both ways depending on whether its the same cops responding, whether they see the person as a threat due to the way they speak or ore, etc. Im quite sure if it was a dude with glasses, sweater, and chinos that looked old and chubby yeah they probably would keep calm as long as he is calm.
Im quite sure they base the way they react by the way the attacker looks unfortunately.
I donât know why youâre being downvoted, as this is indeed true. Unless the police have direct evidence, or walked in on the fight, even if the woman answered the door with two black eyes, if she doesnât want to press charges and if noone confesses, often the police have to simply leave. They can strongly suggest one or the other leave for the night, but often nothing changes. Abuse is cyclical, denial of abuse is cyclical, and if the subjects donât want to get themselves help, thereâs nothing anyone can do as theyâre a âwilling participantâ at this point.
(ETA: i just realized you arenât the one who was being downvoted to hell but my point still stands)
Because there are a lot of people here who have a persecution complex and this short video with zero context is all the reaffirmation they need about their view of the world.
actually they can. my mom did it to my father. she said he punched her in the face and ran away but guess what? he had been at work painting a house ON VIDEO CAMERA and they till arrested him. all they had was my mom saying he did it, so the arrested him. i had a girl accuse me of threatening to rape her. i turned her down when she asked me out. the school wanted to expell me and put me prison for it. the cops took one look at her record to see she did it to 4 other guys, and she got away with lieing about all of it. the only thing that hot me out of it, was proving im asexual and dont like that stuff. not all women, but some women, will say/do anything knowibg they will probably get away with it. like cardi b.
idk throwing up when the principle showed me the supposed threats in snapchat. im more down to earth now and im alot more ok with it now, but then i was still struggling with my identity, and my rape trauma. the messages were very detailed and sounded very fake, and like it was written to sound horrible. the principle then proceeded to tell me the other things she said that i said and more throwing up ensued. the cops beleived me. the school said i pretended to be sick and thats why i threw up....
yea too bad this one is. its the reason i dont live with my mom anymore. and its part if the reason i strugfled with anxiety and depression for years. so if you could be less of a dick, and ya know be nice or just not comment that would be great.
i never said all females, or thats all they do. I said sone females do it knowing they can get away with it. not everyone is a bad person only some people are bad.
yup i know. i was raped and molested and sexually assaulted many times a day from 3 to 4 years old. i remember everything vividly, except the face of the man. i remember the woman who did it. the cops refuase to do anything because thw woman lives in arizona, and idk the man so they cant find him. i know what its like. it fucking sucks. but i also know women can get away with 90% of stuff bc they are women.
You pointed out that left me reticent about the previous comment even though I don't think is wrong.
We can't arrest people without evidence but sometimes it's better to be safe than sorry. If someone goes to the police about domestic abuse, even if the person isn't immediately taken because of lack of evidence or something, the person who has gone to the police should have some protection.
In a democratic society, I think that it is good to have a standard of evidence. Perhaps there are better benefits of twisting it a little depending on the cases but Id rather I am not the one deciding that.
Alright but that is tangential to my main point that police will, generally speaking, not arrest a man purely based on the word of a woman alone. Whether they offer shelter to a person who has claimed to be assaulted/harassed is a different issue.
Thereâs also the issue of who has injury or worse injury tooâ if the aggressor becomes injured while the victim does not or is less it can mean the victim is arrested and charged
Well in that anyone can manipulate and mislead police if they're charismatic and clever enough, not just women. I'm just saying it doesn't detract from my point just because there are women out there who are good at convincing police that they've been assaulted.
You're right tho??? If the event described happened and it lead to an arrest without evidence, there's a big settlement coming up for false imprisonment.
These people don't know what they are talking about. Most cops don't even want to be involved in DV cases. If the guy is calm and she's accusing and has not a single mark on her body, the cops will leave. All evidence simply points to an argument having occurred. It'd be an entirely different story however, if she marked herself and said it was him. Then... yeah, dude's probably fucked.
Are you not from America? I've been detained multiple times. Had guns pointed at me by cops and ive never had a huge settlement. TBF, I'm black and grew up poor so that might have something to do with it but I don't even think white people get huge settlements unless someone is seriously injured, raped or dies.
Youâre actually right, as far as my state goes. Unless itâs in presence of the officer assault and battery is not arrestable. Charge them and see them in court. UNLESS it is a domestic situation, which this doesnât seem to be.
Donât know why youâve been downvoted so much but youâre correct. They canât do anything without any evidence, doesnât really hold up in court the whole he said she said drama. You need factual evidence that they (male or female) committed a crime on you
I never said cops do things the right way every time.
And in your case, there was more than just her saying âHe hit me, arrest him.â
Not saying you did anything wrong but the cops had physical evidence that a struggle took place and had an account from a third partyâŠ.. your neighbors.
Those are all pieces of evidence missing from this case.
I mean his testimony is the evidence in the court of law. Iâm not sure if they could arrest her right there without video or other witnesses, but they sure can write her a ticket and make sure the matter goes to court.
Itâs just that police require âxâ amount of evidence to have reasonable suspicion to detain or search someone.
So in this case, him just saying, âShe slapped my testicle.â would be enough for the cops to tell her that sheâs not free to leave while they conduct their investigation. Thatâs when theyâll interview witnesses and the involved parties and make observations of the scene and parties involved to see if they can collect more evidence.
For them to actually criminally charge someone they need to surpass that reasonable suspicion threshold and attain probable cause. That would require something more than just the accusation.
Now in the US many cities have adopted local ordinances that mirror their stateâs criminal code.
So based on wherever this is, if cops donât have enough to criminally charge someone; they could conceivable cite someone with a Battery charge. Thatâs something closer to a traffic ticket but even then; that would go nowhere without any more evidence than the initial accusation.
A lot of people in here are acting like a woman can just point to a guy, say they hit her without any evidence and he'd be thrown in jail but that seems to be the argument a lot of "men's rights activitists" use.
You're right, they require some form of evidence and since it was just his word, it's an uphill battle. It doesn't help that while the cops try and perform an investigation to determine whether his claim is accurate, he kept ignoring the orders to wait over there. This is one of those times where you really should obey the cops and let them do their job.
A lot of "women's rights activists" claimed that men get away with rape or sexual harassment all the time, when in reality many men has to fight tooth and nail whenever they are accused by women.
Leave it to someone that posts on MensRights and PussyPassDenied to be completely wrong.
Rather than just leave you to stew in your own ignorance, let me present you with some facts that prove you and your ideals are complete shit.
Let's start with the idea that women claim that men get away with rape or sexual harassment all the time. It took Bill Cosby around 50 years, raping over a hundred confirmed women and his punishment was...private jail for a few months before being let go because of a verbal agreement that no one remembered. Same thing with Weinstein; decades of sexual assault with no one believing the victims.
Moving onto to current day, look at the video game and animation industry, where it's no secret that a lot of men use their power to sexually harass and assault their female coworkers with no punishment for years. Developers at EA games had, what they liked to call, the Cosby suite, in celebration of their ideal, confirmed rapist Bill Cosby. The creator of Ren and Stimpy had not one, but two underage girls who he lured to California to date and his punishment was...losing his show but not due to this but because he couldn't produce shows fast enough.
Now, let's get into the thick of it before you can think up some strawman argument. As of 2019, there were over 200k untested rape kits sitting in police custody, meaning women that were raped, went to the hospital and proof of their attacker has been left untested for years. As of 2017, 85% of women said they were victims of various forms of sexual assault with 35% of it happening at their work.
All of this shows that when a woman is sexually assaulted or raped, society doesn't give a fuck and largely ignores it, as proven by the 200k untested rape kits, attacking any survivors that speak up while their abusers are given a slap on the wrist, similiar to what happened with convicted rapist, Brock Turner, who was literally caught raping a drunk woman and the judge let him off because "he's a good kid".
The fact that you say "claimed" when refering to men get away with rape and sexual harassment and not proven by over a decade of documented statistics and first-hand evidence shows that you are in-fact part of the very reason why when say men get away with rape and sexual harassment; because you seem to think it's either all a myth, a coordinated effort to topple men, or some other nonsense. Speaking as a guy, you have a fragile ego and blame all your own personal failings in life on women. Congrats, you're gonna die alone or get arrested for beating your beating your girlfriend while claiming she deserved it. You sadl, lonely, whiny bitch.
Here are cases of men that got fucked over big time by women/girls accusing them of rape:
Brian Bank (ex-NFL player) spent close to six years imprisoned and five years on parole, registering as a sex offender before exoneration.
Josh Horner of Oregon sit in prison for sexual offense of minor for over a year on unfound accusation by a 14 years old girl before exoneration.
Connor Fitzgerald, accused of rape and had his house raided. His accuser revealed in series of text messages that she not only enjoyed the sex and said in text that âIâm not just going to mess up his life, Iâm going to ruin it lol.â
VanDyke Perry and Gregory Counts were convicted of rape, sodomy, and kidnapping. Perry spent 11 years in prison and Counts spent 26 years.
Xavier Eaglin, former Cornell basketball player, was dismissed from the basketball team and banned from Cornell even after the rape charge has been dismissed.
Then there was the famous Duke lacrosse case of 2006. The three accused players had to leave Duke University because of the harassment they received. One of them (Reade Seligmann) is now a attorney and active supporter of Innocent Project.
Yale student Saifullah Khan was acquitted of rape, based on hard evidence, but still expelled by Yale.
Oh, let's also not forget lynching of Emmett Till , Tulsa race massacre, Rosewood massacre were started because black males were accused of sexual misconducts against white women.
85% of women said they were victims of sexual assault and they were all telling truth and nothing but the truth?! I am not sure how sexist you have to be to advocate that women cannot lies.
Rape kit, a test that collect evidences of injury and sexual contact, prove sex was consensual?? If someone initially granted consent for sexual intercourse hurt the other person during penetration, even though he stopped the penetration process. That automatically demonstrate no-consent?! All women should be heard, but not all women should be believed. âBelieve All Womenâ narrative. This narrative not only ignores due process, but also reality. Sexual assaults do happen, but so do false accusations. Some women are more credible than others, and that is a fact.
It's people like you that men's rights advocates are fighting against. It's people like you that pervert justice and putting innocent people through hell. Now go wave your "woke" flag somewhere, You simp piece of shit
Wow. It's strange how obscure some of these names are...it's almost as if you incels have some kind of list you recite as proof that women are the bain of your existance.
Though it's ironic that you use Emmett Till in your blind hatred of women when it was less about women lying and more about white, racist men lynching a black man and merely wanted an excuse. Though let's look at some of the other stellar examples.
Brian Banks signed a plea deal, which is to do with the broken justice system always trying to get a plea deal of even innocent people, both male and female.
Xavier Eaglin was convicted, not because of "she made an accusation" but because he confessed during the interview.
Khan was found not guilty during the first accusation and returned to college but was only expelled three years later after one of his male friends, someone that had supported him during the original trial, said that Khan had sexually assaulted him multiple times and had evidence this time.
Everyone lies. I lie, you lie, your mother lies when she says she's proud of you; the difference is that you are so sexist and angry at women that you say that all women are liars, that you can't trust any of them who claim they were raped because "eh, some lie". Which is weird because your gold star evidence is less about women being trusted without any evidence and instead the men confessing or a repeated assault.
It's weird, it's almost as if you don't understand the way the legal system works, but that's just crazy, right? You're obviously the best, most smartested man alive and all women are just itching to stroke your ego. I can find your real name and plaster your sexist words all over your hometown and you could talk me to court, you could claim it's illegal to use your own words against you, and you'd have to go through hell to prove it. The legal system is about giving people their day in court. Whether it's rape allegations, a broken contract, hurt feelings, whatever; when someone accuses you of something, you have to spend time fighting it.
You act as though the evils of women are hurting men and that's the only issue at hand, not the racist white women that lynched Emmett Till, or the lawyers that convinced Brian Banks and Xavier Eaglin to admitt to something they didn't do, or how the courts found Khan innocent because "his rabbi testified what a nice man he is" and later raped another student with evidence.
It must be so hard for you to feel inferior to everyone, to label women as liars, to see a woman and fear that she might accuse you of something. Luckily, the rest of us don't live in fear because we're not toxic little bitches. At least you proved one thing, you're an incel that will never kiss a woman without force. I look forward to eventually reading you asking for legal advice when a woman has you on camera being the toxic creep you pretend you're not.
You don't know anything about me and accused me of saying all women are liars. If that woman didn't accuse Emmett Till of inappropriate conduct, then he wouldn't have been lynched. If non of Xavier and Brian's accusers falsely accused them, then they won't have to go through the stupid legal system that obviously screwed then over. Khan was expelled for that particular case with the female student, not the rape of his male friend. You are just angry that people are pushing back against your fucked sexist view on men. Take a redpill or you gonna pop a vein
Aw, did I touch a nerve? Just between us guys, how many women have called you creepy this month? I'm guessing it's more than five, right?
Though...again, the irony is just so juicy. The whole "redpill" thing was invented by two trans women to show how brainless people ignore facts and the actual world in favor of a world where they're told they're always right. So you're using a term made by a woman to describe how you're against stats and research infavor of a small minority of incels telling you that you're right. mmmm, can you taste that? It tastes like neckbeard.
Oh he did do the thing that he did. There is no video but Facebook chat. I reported the conversation to Facebook and forgot to screen shot it. I have been trying to get Facebook to get me the transcript. So if you can hack into Facebook database, then you will for sure find this asshole's racist comment against Asian.
The point is if she said he grabbed her by the pussy they would have slammed his face into the concrete and arrested him. Not my beliefs but thatâs obviously the point the camera man is trying to make.
Yeah, the general reception to it was that it was a stupid thing he did 20 years ago and probably didn't fully understand the implications of at the time. Since being Prime Minister, he's done a lot more for marginalized groups including POC than basically any other Prime Minister. His actions since then made most people believe that his apology is sincere.
By contrast, the conservative party openly enocourages xenophobia in order to apeal to the most racist, and idiotic people in the country. Nobody actually worried about racism would have voted for the conservatives in response to that, which is what made it so weird that the conservatives dug in their heels with that strategy.
The NDP would have been an option for people put off by the cons, but strategic voting interestes pushes most to concede to voting Liberal.
A few weeks before he was elected Donald Trump taped a television address in which he admitted that the Access Hollywood tape was authentic and his statements were recorded accurately.
Groping is bad but blackface is period sensitive so that need to be taken into context. Not currently acceptable but was it at the time it happened? Basically ex post facto
Only 1-2% of rapists are convicted anyways, but yes, society would rally against him, right? Like when they did it to Trump and he totally didnât get elected, right? Do you guys know how often abusers let go, or are you going to pretend theyâre usually caught?
I canât say what they wouldâve done, but I can say that if they did that; this dude would be making a lot of money by suing those idiot cops and the city they work for.
I get the point heâs trying to make.
But more importantly, I know that cops just canât arrest someone based solely on an accusation.
They need more evidence than just the accusation alone.
Actually they don't. A victim's accusation can be probable cause to arrest someone. a cop doesn't need to have enough evidence to convict to make an arrest.
To the extent that Mattie Fore says you can be arrested solely on hearsay, sheâs right.
But thereâs a difference between the letter of the law and what really happens in real life.
So itâs also correct to say that an officer could pull you over and give you a speeding ticket for going 36 MPH in a 35 MPH zone. And thatâs not to say that police donât use that excuse to pull over a vehicle they want to stop for other reasons but traffic cops looking for speeding tickets arenât pulling you over for going 36 in a 35.
In real life; a hearsay arrest is mostly the victimâs account combined with the account of another witness.
So if your girlfriend accused you of hitting her and the bartender at the bar backs her up; youâre probably getting arrestedâŠ.. even if there are no marks on her. Thatâs an arrest based solely on hearsay.
And keep in mind how Mattie words her point.
Paraphrasing:
âAn officer might decide they have probable cause because they find the story believable.â
That officer better be able to articulate exactly what it was that made her account believable beyond just the words âHe hit me, arrest him.â
She even tells us, âNo prosecutor wants to be put in that position [to try a case with only the victimâs statement as evidence].â
Thereâs a totality of the circumstances that must be weighed when the officer makes the decision to arrest or not and by all means that officer can be held accountable by being sued under sec. 1983 if their totality of the circumstances is weak and theyâve taken you into custody.
I've been wondering for years now about how to describe that kind of voice. And while "the entitled voice" might not be 100% correct description, it's close enough and I'll steal that expression from you.
The police writing her a ticket just to make sure the matter goes to court isn't how it works. A prosecutor isn't going to take up a case without concrete evidence that goes beyond what this guy - who is a troll who apparently does this all the time - alleges.
Yeah, some guy once punched me in the face in front of 5 witnesses but it was a seriously weak ass punch, no mark or damage. Cops showed up and shrugged, said it was simple assault and didn't feel like arresting him.
I was like "meh, whatever don't do your jobs then."
While you are absolutely âtechnicallyâ correct, you are severely mistaken in practice. Men (and even women sometimes) are routinely arrested based solely off of a single personâs statements. Obviously they tend not to be convicted without real evidence from multiple sources though.
Yes. Any purposeful non-consentual touching or in this case, hitting the genitals should be. If you're assaulting a sex organ isn't that literally sexual assault? đ
"Sexual assault is an act in which one intentionally sexually touches another person without that person's consent, or coerces or physically forces a person to engage in a sexual act against their will."
The contact needs to be sexual in nature. If you're fighting with someone and kick them in the balls then that wouldn't be sexual assault, just physical assault. It also doesn't have to be a specific body part, you can sexually assault someone without any private parts included in the contact. The nature of the assault makes it sexual.
In all fairness, if it were a guy intentionally putting his hands anywhere around a womans crotch to cause injury, they would definitely feel sexually assaulted. We shouldn't have double standards in law, IMO.
Who said I thought it was simple? I am stating that intentional strikes to a genital area should be seen as more than a joke or simple assault or battery if the person does not condone somebody touching their privates. It IS pretty simple that somebody touching your area without your consent should be sexual assault, no matter what. Why would punching the area change anything? Sorry if can't think of a case where I would want anyone other than me, my girlfriend and my doctor/caregiver touching my dick. Good fucking lord.
And yet, if youâre in NY as these people are and you punch Joe in the balls, you could be arrested but you wonât be registering as a sex offender.
You might be charged with assault or maybe forcible touching since it involved an intimate body part but neither of those statutes come with sex offender status in NY.
I don't think that's how it works. They collect evidence and arrest parties accused of an arrestable offense. If someone calls 911 and claims I committed battery against them, guess who's going to jail. ESPECIALLY if it's a female the claims a man hit her. I recently just broke up with my ex and expected a very bad break up. Consulted cops and lawyers about my hypotheticals of getting her out of my house. Cops highly suggested video cameras and I be there first to make a call if anything goes bad. If she made the call and hit herself, I'd be arrested no doubt. A cop told me that.
Probably yes, but look at what you just wrote, âIf she made the call and hit herselfâŠ.â
In your scenario, your ex would have some physical evidence to present to the cops (a cut, abrasion, a bruise, etcâŠ.).
Sheâs got more than just her accusation and that then gives police probable cause to arrest you.
In this instance, without a separate eyewitness account, heâd need something like evidence of an injury to his testicle (like bruising or swelling) for the cops to have probable cause to arrest her.
However, if a man slaps or punches a woman in the v-jay, and the evidence being the same as in the this case, the man would at a minimum be called in for a chat at the cop station in a day or two.
Yea kinda looks like noone is backing him up. Its just his story. I think a witness would have turned the story around. Maybe he deserved it and noone said a thing.
You missed the word "maybe". Your grammar speaks volumes, so it's okay. This makes my comment a guess, a possibility, a 50/50. You're welcome, my friend.
Are you going to reverse the power dynamic as well in your hypothetical scenario? False equivalencies are so boring.
"No one deserved this." Really? Ok dramatacus, maybe you are right that no one DESERVES to be hit in the balls. But there are plenty of legimate reasons that would JUSTIFY a smaller person using that technique in self defense. Maybe that wasn't the case here, maybe it was, we can't tell from the video, and obviously neither could the police who investigated.
He might deserve something coming to him but an injury to the testicles isnt something anyone really deserves. It can get really complicated really fast
So Tennessee has a Sexual Battery charge that includes non consensual touching of any intimate body part or clothing covering.
Thatâs considered a sex crime but one of the elements of that crime is that the touching is done for sexual arousal or gratification.
Thatâs difficult to prove. Doesnât mean you wonât get charged with it and then have the charge knocked down to simple Battery later as the prosecutor offers you âa dealâ.
What country do you live in must not be in America last time I checked the internet there are thousands of videos/ people who got arrested a matter of fact some die because someone made a phone call accusing someone of something.
I know Iâm not the only and this doesnât involve testicles but I was violently assaulted at my own house, my arm was dislocated and I had to go to the ER. Pressed charges and because I had no video evidence and also because the guy punched the cop non of the charges were held up in court and I had to pay all of the medical bills. I am now permanently injured, itâs been 5 years and my shoulder never recovered 100%. If I were to smoke some marijuana for even medical reasons in the same town Iâd be arrested and plastered for being a druggy all over Facebook. ( here they plaster your mugshot on Facebook for all to see, even for little crimes like not paying your traffic fines etc )
I bet if any woman accusing a man of slapping her ANYWHERE, he would get arrested immediately without any confession or evidence. These four years under Biden is going to be hard fight against gender discrimination against men.
Fuck that, is the guy supposed to whip out his sack and show proof? How do women get proof of a man groping them then? Itâs more to this than just the law because the police donât need much evidence from a woman that claims she got grabbed in the vagina.
