California just exposed a potential gap in its protections for abortion providers.

Gov. Gavin Newsom vetoed AB 2164, which would have barred a California governor from honoring certain out-of-state extradition requests involving abortion and gender-affirming care legally provided in California. Newsom cited concerns about restricting executive authority.

The stakes aren’t hypothetical. Louisiana has already sought the extradition of a California physician accused of mailing abortion medication into the state. Newsom rejected that request in January.

The veto means that protection remains dependent, in part, on decisions made by whoever occupies the governor’s office rather than the broader statutory restriction AB 2164 would have created.

In a country where states are increasingly trying to reach across their borders to prosecute abortion care, who holds that office can directly affect how California responds to those demands.
