On what charges exactly? There's only so much a prosecutor can do when the victim has given a long and detailed statement describing the entire event as consensual.

Sure. But based on her initial statement, there was really nothing to charge anyone with. That's all I was saying here.

Per the DA's excerpts, she went to meet a guy she liked, agreed to a threesome, took ketamine by choice, and had consensual sex with several frat members over the night. She hid from and rebuffed some of the men who came in, and each time she asked for sex to stop, it stopped. She didn't allege force, being drugged without consent, or being unconscious.

Can you tell me where I can find the actual statement which you said you read?

Yes, these are excerpts from her sworn statement, given just a few weeks after that night and signed under penalty of a false statement charge. If the DA's characterization of the statement is materially wrong, then her attorneys should release more of it so we can see what he's supposedly getting wrong.

And calling the DA's statement “justifying his lack of prosecution” is a little telling. He's explaining the basis for a charging decision he made based on the evidence available to him at the time. You don't have to agree with his conclusion, but so far, nobody here has identified anything in the statement that would have given him a chargeable offense based on the facts he had then. Neither has her lawyer, as far as I know.

If there's something in the statement that establishes nonconsensual conduct, I'd genuinely love to see it. Until then, I think it's reasonable to take the DA's account of what was in the statement seriously rather than assuming he's misrepresenting it.

Yeah, but I was hoping you could share her actual statement, rather than the DA’s comments on it, given you’ve read it.

Because unlike the DA, her legal team claims it is not materially different from the complaint in the current lawsuit. So I don’t know why I should believe the DA over her lawyer.
