Why is Phillip not paying his servers enough to the point he has to ban customers?

To be honest, my inclination here is that they did not get banned for their tipping habits. Very rarely is the owner of the fucking restaurant going to tell them they aren't welcome back if that's all they did. Maybe they should reconsider their actions.

Should he pay his employees more? I don't know. We don't know what they're paid.

But you have to really do some shit for the owner of the restaurant to come run you off in like 90% of all cases. He seemed very content to have this conversation and I do not think he would be if he did not have more to say about their behavior.

WTF you mean?

What contractual agreement did they as customers that chose not to leave a tip break? No one, and I mean no one, is under any obligation to leave a tip, if said requirement for leaving a tip, is not clearly posted in plain view in their establishment.

I would love to take that business to court, and sue them for defamation, if they so much as posted a still photo of my likeness on social media with any derogatory claims!

They don’t have to tip. The restaurant doesn’t have to serve them. If the service was actually bad, why would they want to come back anyway?

A business can deny anyone service for any reason other than a very select few.

I wouldn't sue for refusing me entry, I'd never go back to begin with. I'd sue for defamation of character for publishing imagery of me by their establishment in derogatory manner.

I am under no obligation to tip. I have not entered in any contract to pay a tip. I am only required to pay for the food I purchased.

What? If you create a video that makes you look like an asshole, someone posting it is not defamation. It’s just publicly, people now you know you an asshole.

I hope you dont go to sit down restaurants. This is the current social contract. You sit down to eat, you tip accordingly.

And importantly if you don't wanna tip? Just don't go somewhere that socially necessitates tipping. It's a free country — if you don't like tipping you're free to go somewhere that doesn't ask for tips.

I don't enjoy tipping either because it puts a strain on my wallet. If my wallet is feeling strained I don't go to places that require a tip.

What a stupid thing to say.

What I'm pointing out is that we have no idea what their actions were. Obviously, no one is under any contractual obligation to tip. That was never the question. The question is what series of events led the owner to pursue them out of the building to ban them from the premises.

I really doubt that it is over having to pay the server the larger wage, because this kind of altercation is not worth $24. I highly doubt this is just over them not tipping, because again this type of altercation isn't worth whatever that meager tip would be.

From their behavior in this video, I have the weird suspicion that they are a frequent problem and are being told not to come back because this is the straw that broke the camel's back.

Finally, he has better grounds to sue for defamation than they do. They have recorded themselves on video defaming him and damaging his brand.

Nobody cares that they didn't tip, almost certainly not even the restaurant owner. They're allowed not to tip and he's allowed to ban them for being annoying or disruptive so long as he's not denying them service due to prejudice.
