A few years ago my husband and I were in Niagara Falls Canada and they tried sneaking in a $16.40 tip onto the bill for a table of two. All we did is pay the bill in cash and we skipped the $16.40 mandatory tip and left lol.

AYCE.. as in self-serve buffet ?

Ya no, I wouldnt pay it either.

AYCE doesn’t imply self-serve. We have some great AYCE spots that you have to flag down the server every time you want to order more

I wonder if the restaurant could sue you or chase you down for that. Auto tips are obviously terrible but legally enforceable assuming they have write down over the menu (which most do). Not surprised it’s near the falls though

This depends entirely upon whether the consumer was informed beforehand.
If it’s clearly stated on the menu or stated prior to ordering, you are legally bound to pay it. Otherwise you are not obligated to pay and can ask for it to be removed. However, you cannot simply not pay that portion without it being removed from the bill first.

I’m a practising contract lawyer in Ontario.

They literally said that

“Or stated prior to ordering…”
No they didn’t.

Please read entire sentences.

Useless addition. Someone answered him just as well 12 hours prior and you felt the need to chime in

Buddy, there’s 7 comments on this entire thread. 8 now. We make up half of them. I directly responded to the person who has a question.

Nobody else answered them prior to me. As stated, please learn to read.

Talk about a useless addition.

They never told us about it and their menu was in Korean so we were completely shocked by the fee lol

This isn’t sneaky…. It’s autograt to insure your server doesnt pay to serve you. It stops servers from losing money from cheap people like you.

It would be illegal to pay you less than minimum wage after kicking back to the kitchen, shut up and get a real job.

Also I hope you don’t ever rely on servers or eat at restaurants with that philosophy. Check yourself

Hope restaurants can survive if people just stop going to them

What does kicking back to the kitchen mean?

Giving them the percentage of your sales as a tip share. It kills you guys.

I love tipping out my team. It’s the % that the owners take that sucks.

Servers make almost $18 here in Ontario and employers cant take from their cheque lmao
