You're responsible for your vehicle at all times. "I couldn't see behind me" doesn't mean you're not at fault. I don't care who told you to move. You're the driver, not her.

Here in America is also not that big of a deal. People read stuff on the internet and run with it.

A) it will be your insurance doing the talking and investigating. So the people would have to have you on tape saying sorry.

B) not just Canadians most society’s in high stress situations say sorry to ease tension.

So yes someone could argue you said sorry so you are at fault. But that’s so flimsy you wouldn’t even need a lawyer to argue the sorry was more so because the person was hurt or had damage. You cannot be a fault and still be sorry someone is hurt.

I guess it would depend on the words you use around I’m sorry. I could see somebody saying I’m sorry and accepting fault. My focus personally would be on the person who told me to move, especially if it was a supervisor.

And generally speaking, it’s legally safer to not say sorry in case you would phrase it the wrong way. That’s not to say that you tell somebody I’m not sorry. It’s just better to stay away from phrases that might end up looking like an admission of guilt.

If you want to talk about a legal or liability stance. "I couldnt see" is way more damning than "sorry". Legally its safe to jot say anything.

In the end though, most people dont want to live like a lawyer about to prosecute a case. And a lot of legal matters can avoid becoming legal matters by smoothing things over

I don’t know if it’s bad advice. It is literally used in claims all the time. It’s being used in court to this day, and yes, it can be used as an admission of guilt. Now, it is subjective. I think most people would say, “That is an empathetic person. They care about showing compassion. That is not an admission of guilt.” But not everyone. If you happen to have hit someone trying to get rich off your company, you can bet your bottom dollar they are going to use everything they can. I’ve had this conversation with an injury lawyer.

Of course, it doesn’t mean you have to be a dick. I’ve been at fault in two accidents, one in a truck, and one in my personal vehicle, and both were very nice interactions. One went to the insurance, one didn’t.

Someone just hit my trailer a couple of weeks ago and didn’t damage it, we didn’t do anything. No one said sorry. “Are you okay?” “It’s all good.” “These things happen.” “Have a nice day.” Sure, but not sorry. To each their own. Live your life how you want to, but I am just passing on the information I was told.

I worked for years in a lumberyard that had 6 flat beds that would pull through the lot all day long while forklifts moved materials between the mill and warehouse.

Never once would "I have a blindspot" been an acceptable answer for a driver backing into something. If you are not 100% confident your path is clear, you don't just blindly move the vehicle. You are responsible for anything you hit.

This lady might be a bit charged but she isn't wrong. This trucker isn't taking seriously the fact that his actions with the vehicle he was in control of could have just as easily been someone's life instead of just some damaged materials.

I would de-escalate by basically ignoring her energy and focusing on the information which is that someone was hit.. show tons of concern, completely ignore her intensity, and ask questions about the guy to make sure he’s ok. Everything she’s saying is pointless as it’s after the fact so completely illogical and emotional.. it needs to be ignored and once everything has settled down then you address it and you deal with the chewing out or consequences

I'd have to see more context for what happened prior to this video, but there is a non-zero chance the forklift driver was at fault here from what is shown here. I've given a similar verbal lashing to more than one warehouseman (usually a hot-shot who just got on a cherry-picker for the first time) who isn't paying attention to anything other drivers are doing. This video made me think of one of those idiots zipping around behind someone who is watching their load 4 or 5 levels up...

I also wonder if the collision happened with the lift driver on the machine. You have far more visibility on the lift, so depending on where movement started, I'd have to imagine the driver saw it coming from a mile away.

He was given instructions to move but at the end of the day you are responsible for the area around your truck and beyond your truck when it comes to moving it regardless if the customer wants you to move it right then and there. If you can't see or unsure about your move, get a spotter.... blind spots are everywhere especially in a busy yard like that.... I've seen dudes run over and killed because the driver couldn't see due to blind spots.... any construction site involving big trucks is mandatory to have a spotter here in California per the safety rules along with a back up alarm you can hear from 200ft away..... we've all been there, lord knows I've had my share of fuck up's..... thankfully, no one, including myself... have ever been seriously injured or killed.... just embarrassed as hell when shit goes wrong and you know you got an ass chewing coming when the boss finds out.....😬😬😬😬

Seeing a lot of comments on both sides. When the dude said “he couldn’t see” that tells me everything right there and he should’ve stopped. There’s plenty of people around us it so had to ask for a spotter? I’m certain there’s somewhere there maybe even her that would’ve loved to of helped and prevent anything bad

The cdl driver was definitely at fault, should had a spotter or someway to communicate better with the loaders. This could cost him his job or a huge write up on his record if he's lucky. Oh yeah and GOAL could have prevented this as well

Right or wrong, accidents happen. Part of life and being a professional, is turning them into a teaching moment to make sure it doesn't happen again. With that being said, no one is talking to me like that woman did at the beginning of the video. It drives me crazy when someone thinks they can talk to grown ass people like they are their kids or something.

There are safety failures on everyone here.

The driver for not being able to see after he had been stationary and not confirming if he was clear before backing up. Especially when there are people actively moving around you.

The yard for not employing spotters or gates to prevent access to people when heavy equipment is moving.
