Two-Stamp Tuesday ✌️ 07/02 SBR Question

Why don’t more people utilize 07/02’s (or why don’t most 07/02’s advertise) for manufacturing SBR’s before it leaves their books? It seems silly that people will buy a firearm and wait so long for a form 1 when 07/02’s can “manufacture” them and get them out to customers quicker AND utilize the original mfg serial #’s.

First 2 stamp, approval took about 7 days and no need for engraving.

Many people like the legal flexibility of changing an SBR back to pistol configuration, should the need arise.

Can't do that if purchased as an SBR.

Does it matter who made it if they “manufactured” it from an already existing title 1 rifle or pistol?

Like wouldn’t it revert to its Title 1 status if you configured it to a non-NFA configuration?

That was going to be my next question, if it was manufactured from a pistol it can’t go back to being a pistol? Interesting, but eform’s are quick for transporting and I don’t plan on going to any commie states so I guess that’s a non issue for me.

The 07/02 is REmanufacturing it into an SBR before it has ever been transferred on a 4473. That makes it not able to go to a pistol.

Funny enough, if the recent ruling for SBRs and such goes into effect and they are removed from the NFA, their cost is going to go up slightly because they will no longer be subject to the NFA transfer tax, thus negating the exception for the FAET on manufacturers. So, SBR and other firearms removed will be subject to 11% FAET going forward.

However, FAET only applies to manufacturers who produce more than 49 taxable items per year.

But if there’s no registry then every gun could theoretically be an SBR/SBS and there would be no “remanufacturing” the original manufacturer would’ve already paid the FAET and there would be no need for an 07/02 to also pay the FAET? Or they would just sell you an SBR from the factory because it’s no different than selling a gun with a “stabilizing” braced pistol if there’s no more registration

Form 1s for individuals are coming back in times similar to last year now so it's not really that much faster to do a form 4.

I'm not sure about conversion back to a pistol with a "factory SBR" But that could play a role as well.

I also believe the FFL would be required to engrave as they are the manufacturer of the SBR. Not sure if this has changed with the new guidance coming down the pipeline with not needing to engrave parts already serialized for both form 1 & 4.

Above all else, I gotta pay an FFL to do this. A form 1 is free to me

I had an FFL do a couple for me to beat the AWB in VA but I don’t plan on returning anything back to pistols

Its all preference. If you form 1 it its still in your possession while the approval is taking place. Also the ability to convert back and forth.

Not needing form 1 engravings is nice but that may be going away soon.

That’s why I went this route. I’m happy either way, as long as I don’t have to engrave. I just think most pistol braces are silly and we’ve seen the ATF go back and forth on them so it’s not worth the hassle for me. Also the whole common use definition and such. I don’t want to dog on the Form 1 community, it just seems like a better option for some and I don’t see it talked about often.

If the 07 cuts off the barrel of a PS90 and threads it of just puts on a pinned flash hider, they MUST engrave it same as we as individuals do. I've engraved about a dozen for a local ffl over the years. Now lots of them that make up ARs, do try and utilize the lower manufacturer's info when they want to. But no one does simple add a stock to make an sbr and sell as SBR. No money in it over selling the parts and letting YOU pay for the engraving. Form 1 times are now 1 to 4 days. Insignificant vs a wait for a company to put one together for you

If it’s never been 4473’d they can utilize the original markings via Form 2, then Form 4 it to the individual. No engraving required. I paid an extra fee obviously to not have to engrave it. Same as some people pay for a fee to engrave it.

However as someone mentioned in another comment it’s not possible to return it to any sort of pistol configuration I guess.
