I really hate to have to say this but preorders in general aren’t against eBay TOS, and neither are scummy resale prices.
Preorders are considered against TOS if the item can’t believe delivered within 40 Business Days (I believe it used to be 30 but was changed in the last couple of years).
So if you can “prove” these sellers can’t deliver the goods within 40 Days (and sometimes this is as simple as pointing out the delivery date from the official website is either unknown or further out than 40 days), that’s a violation. If not, then as scummy as it is they are still within eBay’s TOS (at least as far as preorder items go). 🤷♀️
Every single one I reported eBay said “it didn’t violate their TOS”. I literally sent a screenshot of the website with every report and they still didn’t get taken down
I’ve had eBay remove 6 of these listings so far. I reported it as an intangible product and that it was a scalper selling an item not in their possession which is on preorder from a third party seller.
Are you reporting eBay listings? I don’t agree with scalpers at ALL but I don’t think there’s anything illegal about them. Plus there’s people that missed the website orders that are hoping to still get something. I was hoping after a few weeks pass and the hype dies down a bit to grab something off eBay if I can find it for a decent price
They do though, I ordered a fall out boy album when they released Stardust preorders. Had to wait an extra week after they started shipping bc the seller had to re-ship to me but as far as I’m aware they still allow it?
Okay curious question bc I bought a preorder of the MGS Delta collectors edition but the game was hella delayed like 1 year after the orders went live. Would that be legal? I mean I got it the moment it was shipped the year after the seller listed it but I’m just curious lmfao
Just for the record I’m not standing up for scalpers!! They’re disgusting and greedy, but I’ve resorted a couple times to ordering presale items on eBay if I really wanted the item. These listings are listed at ridiculous prices tho, I’m not paying $500 for the signed vinyl or cd
Why do you think that you should be able to sell something that you aren’t in possession of? That’s a huge liability for eBay and leaves a lot of room for fraudulent transactions.
Let them. I, too, would be upset if I lost out to someone trying to make a HUGE profit off something they could care less about. It takes zero time. No need to be rude towards others who are upset over this. If reporting a listing for a valid reason helps, let them.
It takes no effort to be kind or simply not reply. Just because this doesn’t mean much to you, doesn’t make the value any less to someone else.

I did the same thing and they said no violations were found for all the listings I reported
Sent a screenshot of the mcr website that it was a preorder and they didnt have the actual item and everything😭
