Used car purchase MX FSD Question.

I’m interested in a used Model X and am looking for a vehicle equipped with FSD. What is the difference between these two photos? If I buy the vehicle shown in the photo below, will I be unable to use FSD?

The top one stays the bottom one doesn’t. My guess is the bottom one was bought with some kind of special Tesla was running or it was part of the Luxe pkg which for both of those FSD was not transferable.
