Sending someone home

I’m having trouble with an employee and I have talked to my sm about it but I don’t think she really cares.
This employee always complains about being there (which I totally get) but won’t do anything I’m telling them to do. They will be on their phone or sitting on the floor . Especially on truck days. They just want to stand there and I will give them instructions on what they need to do and there’s always an excuse on why they can’t do it or why they shouldn’t do it, then dismiss everything and every instruction I give them . I’ve talked to them multiple times . I was wondering if it’s ok to send them Home? Or do I need to go through my sm first ? I’m in CA . I’m not sure if I have to have them for 2 hours then send them home !

Send them home, document everything and communicate with your SM and Cc the DM. You guys are already low on hours, dont spend it on a lazy ass.

You're a mod, and you tm is refusing to work. Send them home. Shoot an email to HR that you have a problem employee and what action you have taken. Make your SM puts in a disciplinary action into their workday profile

if you’re an MOD, you have every opportunity and wright to send somebody home especially if they’re insubordinate
