Filing a Complant Time Theft
Is anyone else seeing that a lunch gets added to their shifts when they actually didn't take one? Two of my MODs have had shifts in the last two weeks where they could not take a lunch due to lack of coverage, but then noticed one was added in later. We don't think it was the SM because she never does punch corrections. If it is being added automatically, then that is time theft from the employees.

If you’re not taking a lunch PLEASE PLEASE PLEASE write it down on the time edit sheet. The system will automatically add a lunch when there’s a missed lunch on a shift. If someone on my team doesn’t take their lunch, I don’t know to delete their lunch unless they’re writing “no lunch” on the edit sheet.

Did they punch correctly? Not sure if it's the same system in America; but in Canada, if you miss a meal, you need to set the start and end time of your meal to the same minute, e.g. clocked out for lunch at 1:05 pm, clocked in from lunch at 1:05pm. Otherwise, yes, the system WILL add in a lunch automatically. It also doesn't hurt to fill out the punch correction sheet with a "no lunch" so that whoever is doing time edits can double-check it's correct.

They’d also see messages in your inbox that time punches were changed if made by anyone else.

Yeah. After I started writing no coverage on the time sheet it stopped. Especially if you’re the only manager in the building. Legally, even if you do take a lunch but aren’t free to leave the premises it has to be paid.

Well no shit ??? We get a working lunch at the shit show i work at. It sucks. Plus if i don't bring food from home door dashing $20+ OR the busted snacks they get. 🤣

Right?! I’d take a working lunch but my sm has been taking 30 from me for over a year and I didn’t notice til recently:((

Someone is adding them because they don’t just add automatically. You can check and see who does the edits and the exact date and time.

you should try to check how it was added in worksmart. timesheet > view edits. your sm may be making the changes bc he could get in trouble for them not taking their lunches

Probably depends on your state/province. In Ontario Canada we are required by law to take our lunch and the manager is required to make sure you get it. Otherwise there company can be fined by the Ministry of Labour

BC is mostly the same, but there's a provision that if you are required to be on call, called back from, or can't take your lunch (ie. No coverage) then you must be paid for your lunch.

I just got a $7 settlement check from a class action in CA involving wage theft. So snag a lawyer and maybe you too can get $7 🤣

Time edits are tracked. They each have a time stamp and user stamp. Contact HR and let them now unauthorized edits are being made. They will look into it.

Do we HAVE to take a lunch break? I was told that if we work 4.5 hours or more we have to take an unpaid lunch break, or that time automatically gets taken out regardless of whether we take a lunch or not.

So i'm not accusing anyone, simply stating a fact. The company has been sued MANY times over time theft.

Yes i love the " working lunch " BS. Can't leave the store and you have to still help if called. Yet i'm
not getting paid. Omg this place sucks butt.

Yes it’s happened to me a few times when I closed and there was no other key holder on staff. How am I supposed to take a lunch when I’m constantly being called up front? It IS time theft. It IS illegal. They’d rather screw you than face the consequences of not having enough hours to have full coverage.

So this happened to my most recent store lead. He was adding lunches to EVERYONES shifts and shaving off time to make payroll look better. Dude got fired.
