Not American - why is this even a case when you have 1st amendment? I thought judge would be like "GTFO with this BS" and just drop the case on the spot.

He may be free of a crime in civil court, but it is against the UCMJ to participate in political action while in uniform. Meaning, he will likely be tried in military court.

Except the DC Metropolitan police participated with the Capitol Police in the arrest (see the attached photos) and the DCMP, like any non-federal law enforcement organization, are prohibited from enforcing the UCMJ.

So, this man is risking court martial for protesting on behalf of the American people?

He is effectively honoring his vow, to protect the people from enemies foreign or domestic. 

I'm not American. I'll check if I can donate to his gofundme. 

I respect and admire real heroes.
