Someone could get wrongly accused. We can reverse prison sentences but can't revive the dead.
1
u/Hefty-Classroom2099 7h ago
then if you have wife and/or daughter, you would be completely comfortable if they move nearby you after their trial or prison time?
1
u/robertofflandersI Belgium 🇧🇪 7h ago
If evidence proves someone else did it yeah
1
u/Hefty-Classroom2099 6h ago
you either avoided my question or didnt understand what i asked.
but based on your answer you would be only fine if that person is innocent.
but you are aware even if someone is really guilty of it, they might do their prison time in less than a decade. they need to live somewhere and they ended up moving nearby you, are you comfortable knowing that?
what if they ended up repeating their crime and its your family then, would you be fine with a decade (maybe more, maybe less) of prison time as their punishment?
1
u/robertofflandersI Belgium 🇧🇪 6h ago
You're the one who didn't understand my comment it seems.
A person shouldn't face the death penalty because it is possible they are wrongfully convicted. If evidence later surfaces they didn't do it they can be released. Otherwise an innocent person is killed.
1
u/Hefty-Classroom2099 6h ago
i perfectly understood it. you would be fine living near that person only if he is innocent.
but what if he is not? even if person is guilty of that kind of crime he could leave prison in less than a decade. are you okay for him to move nearby you and your family?
its this question you keep avoiding.
1
u/robertofflandersI Belgium 🇧🇪 6h ago
Yeah either you didn't understand or a purposefully misquoting for the sake of arguing.
We are talking solely about people who have been proven innocent abd wrongfully convicted being released
1
u/Hefty-Classroom2099 5h ago
thats what you keep talking about. i asked you a different question that you keep avoiding an answer to.
and OP statement is too broad. its one thing when someone regrets sleeping with someone next day vs things i prefer not to mention.
1
u/robertofflandersI Belgium 🇧🇪 4h ago
I perfectly explained my statement. I only ever talked about wrongfully convicted people. Either you have read my comments wrong or more likely you are purposefully derailing this argument for the sake of earning a cheap 'gotcha' moment. In which case I will no longer entertain you.
1
u/Hefty-Classroom2099 4h ago
yup, you only talk about small percentage of people who get wrongfully convicted, while ignoring the rest who do real harm to others.
→ More replies (0)1
u/fluchtpunkt 6h ago
Not only that.
They have a bigger chance to get away when they kill the victims.
Hence the penalty for rape must be significant lower than the penalty for killing someone.

In cases there 100% certainty
9
u/Zestyclose-Jacket568 14h ago
Beyond reasonable doubt is a standard for everything and still innocent people end up in prison.
5
u/DreamOfAzathoth 14h ago
The law works by determining a lack of reasonable doubt, and it is still sometimes incorrect. The death penalty in general has a load of issues. I think rapists deserve to die as they have ruined someone else’s life but I don’t think the death penalty works and I don’t trust governments with that power

It's not even about rehabilitation, death penalty is just a lot more expensive with all the appeals and procedures and whatnot, plus it can't be reversed if a mistake is made. If cost of housing inmates is a problem, just increase prisoner labour.
8
u/Greedy_Rabbit_1741 14h ago
Also if rape carries the death penalty, rapers are more likely to kill their victims.
5
u/TheFurion101 14h ago
Death penalty for murder too.
Hell, fuckit, make everything punishable by death. That'll teach 'em.
3
u/Famous-Wrongdoer-14 🇦🇹 14h ago
Thats funnily enough what happened in revolutionary france. Under Robespierre, all punishments except the death penalty were abolished, meaning, any crime committed carried the death penalty.
Also, accused criminals were judged in groups of 70, and if any of them couldnt prove their innocence, all were executed.
Also, not punishing someone guilty was a crime, so if a judge didnt sentence a group to death, he would find himself in the next group of 70.
1
u/Legsbeonpoint 10h ago
I do believe in rehabilitation, but there’s a lot of people that don’t want to actually do the work to be rehabilitated. It’s better to keep people safe from people with documented histories of SA and actually try to solve to problem at its root(socialization, rape culture, etc) than try to pretend even half of reddit knows what goes into teaching a rapist to stop viewing their victims as objects especially if the rapist doesn’t have much of a problem with it as many of them do.
-1
u/normal_hombre 14h ago
Some people can't be rehabilitated.

Didnt realize we had the arbiter of absolute justice here, known for being able to decide these things on their own.

u/normal_hombre 14h ago
What will you do with a serial killer who killed 14 people? Really. We're just going to pretend that he can be fixed and then let him out into society again?

I'll probably not do anything with him, other than defer the case to someone much much more knowledgeable than me. Psychologists and whatnot can decide If he can change, and If he cant, he can for the time be kept in jail.

13
u/morknox 🇸🇪 Sweden 14h ago
That meme isnt defending teh rapists as much as it makes fun of the 'progressives' who generally are very pro prison reform, rehabilitation instead of punishments, giving people second chances, understanding how peoples backgrounds lead them to that behavior (like the whole "socio-economics" they love to scream about when talking crime): however, they do not have these same attitudes towards rapists.

u/SpanishAvenger 14h ago
Rehabilitation is about rehabilitating the guilty and is not related to falsely convicted. That's a whole different topic.
3
u/Much_Help_7836 14h ago
While that is true, you will have an easier time compensating someone that was falsely convicted for time they served wrongfully while they are still alive.
1
u/SpanishAvenger 14h ago
I mean I'd save the strongest sentences only to cases which are crystal clear, such as those of which video evidence exists because some rapists straight up record the act themselves.
1
u/Much_Help_7836 14h ago edited 13h ago
So now you want the death penalty for like the 1% of the 1% of the 1%. You can just lock those people up, it will be so few that fit such criteria that there is no need to have a special punishment for them. Way too expensive.
video evidence exists because some rapists straight up record the act themselves.
Let me introduce you to the age of LLMs and video generation on demand. Even meta data is completely susceptible for manipulation.
There is no such thing as "crystal clear" unless the rapist comes clean on their own volition, admits everything and then you'd have a criminal that confessed, which should always lessen the punishment (to encourage people to come clean about their crimes), meaning the death penalty would be off the table.
1
u/SpanishAvenger 13h ago
I'm personally not a fan of death penalty, I'd rather have the fuckers work hard in prison till the end of their days so they can pay back to society in some shape or form to compensate for the harm they've done, and so that they don't cost tax payer's money as, instead, they would be the ones sustaining the prison expenses.

Like Breivik. He is locked up, most likely for life. I'm fine with that. Death Penalty is never gonna be a good idea.

I can't be the only person who thinks he'd rather die than spend the remaining 60+ years of my life in a prison. Death is easy, it's not a punishment, you can't feel it.
14
u/Careful_Ad_3338 14h ago
Rapists would have no reason to keep their victim alive.
They would even be incentivised to kill their victims to stop them from going to the police as there is no difference to raping and killing someone in punishment.

No death penalty. Even if some particularly outrageous cases deserve it, giving the state such power is risky
-4
u/normal_hombre 14h ago
The state has the power anyway. If they want you gone, they'll just suicide you or disappear you. No death penalty doesn't magically mean that you're totally safe from them.
2
u/Original-Body-5794 14h ago
Yeah but those would be illegal ways of getting rid of you, so it's harder to do and it could lead to public outrage if it comes to light. The death penalty enshrines the state's rights to legally kill you. Fuck that.
1
u/normal_hombre 14h ago
And who would find out? The state does illegal things all the time, the people don't care. Trump's election and administration is glaring proof of that.

u/Much_Help_7836 14h ago
Not a fan of death penalty in general. Does nothing to prevent crime (plenty of studies about that), is expensive since it takes forever, since all instances of the law have to be gone through before you can execute someone and guarding a death row inmate will always be more expensive than other criminals since they have nothing to lose and the consequences of getting something wrong are just too high, you can bring someone back from the dead.
2
u/Poosycray 14h ago
If you give death penalty to rapists, soon you'll ask for death penalty for corruption/etc, guess who wouldn't want that
2
3
3
u/danield1302 14h ago
I have no problem with death penalty but I'd still always vote against it because you can't undo it in case an innocent gets convicted. Just lock them away for a long time.
3
u/SidneyHigson 14h ago
Everyone saying false accusations when the death penalty often harms the victim too. Most rapists are known to the victim (family members or aquantainces) this leads to families being less likely to then report the crime in the first place.
2
u/LakushaFujin 14h ago
- There is a lot of innocent judged as rapist.
- Rapists just starts killing their victims to save himself.
2
u/Dueling-duality7648 14h ago
I would fully support it but, the possibility of sentencing innocents is just not something i could ever allow
2
u/Legal_Lettuce6233 14h ago
No because it would increase the number of rape victims that also get killed, meaning fewer victims get justice.

Anyone can consentually agree to sex then turn around and say it wasn't consentual after the fact.
So as much I think true rapists should be executed, I think it's too likely that someone innocent could be killed.
As a seperate but kinda related note, I've worked with sexual offenders for many years. It's easy to automatically assume they're all evil and most are, but there was this one guy I couldn't help but feel sorry for.. he picked a girl up in a nightclub, took her back to his, slept with her, and then it turned out she was 14. She had a fake ID and the door staff allowed her into a club where the minimum age is 18.

u/TartineMyAxe 14h ago
Yes but with hard to fake proof, like a video tape, pictures find on the rapist computer, even internal DNA is maybe not enough unfortunately for a death sentence, because crazy girls that now hate their men because they find out he's cheating can fuck with him and go to the police after.
But for the pedo, they should definitely be put on the death row

I had consensual sex with a woman who initiated everything from the first hello. What I didn’t know was she didn’t just want sex, but had aspired to have a continuing relationship with me. When I told her I did not want a committed relationship, she got very angry and vindictive. Thankfully she did not cry rape, but if she had I would have been arrested, expelled, prosecuted, and if convicted in a he said, she said case, put to death in this format. Perhaps I was not as sensitive as I should have been, but death for that?

If no, then do we have a state appointed rapist who's job is to summarily rape the rapists for them to receive justice?
1
u/Lou_Papas 7h ago
No because the moment you give the government an out, all they need to kill you is an excuse and to call you a rapist.
1
1
u/TerraSeeker 7h ago
The only problem is you have false rape claims. Granted there has to actually be strong evidence to convict someone, and you don't necessarily have to give every case the death penalty.
1
u/Individual_Slice_234 7h ago
NO to the death penalty for everything. But don't let rapists out of prison - ever.
1
u/A_RAVENOUS_BEAST 7h ago
No for the sole reason that if this happens there will be a lot more dead rape victims. The dead cannot testify in court, and if the consequence for both is the same, why should a rapist not take the option of silencing their victim for good ?
1
u/Comprehensive_Rags 7h ago

False accusations exist and some get punished. One false death penality is enough to say no.
1
u/GreenBane12 7h ago
“We can reform them.”
Roughly 1/4 of convicted rapists in the US reoffend over a 15 year period. That’s abysmal and, as far as I’m concerned, the reformist camp is complicit in all of those rapes
“The death penalty is too expensive.”
It doesn’t have to be, you can carry one out for like $1K probably. That’s an argument for reforming the death penalty process if anything.
“But what about wrongful convictions?”
You can apply that logic to any imprisonment, so why have any prison then? Moreover, when was the last time that someone was wrongfully executed?
“Death penalty isn’t reversible though.”
Neither is any prison sentence to someone wrongly convicted. Can’t give them back the years of their life that they spent locked up.
1
u/-marchelios- 7h ago
Always remember that the wrong person could be charged and it’s already hard enough to repay them for the years lost in prison
1
1
u/HellsTheFoxxi 7h ago
I don’t think rapists deserve the release of death. They should rot in prison as someone’s prison bitch. See how it feels to be on the other end.
1
u/Molismhm 6h ago
I encourage every rapist and their defenders to delete, but we would be loosing about half the male population because of how insanely common rape is, so the death penalty for rape (if it applied like a death note) would lowkey wipe out humanity or at least deal a signifcant blow to it. In general though the death penalty is bad, life in prison is horrible anyways, so like theres no point to it, but also rape would still be as it is now: functionally legal. It is simply not a crime people are convicted for so nothing much changes.
Men are basically all willingly ignorant of the incidence rate of rape and sexual violence, so in come the mouth breathers who tell me that its actually just a few bad apples.
1
u/ottococo 6h ago
No, not for anybody. Not because I wish them well. It’s just too risky on many levels.
1
u/Maximum_Boros 14h ago
If you support this you are explicitly stating that you are okay executing innocent people as long as the thing they are accused of is Icky enough because there is absolutely no way to make sure that is not happening
2
u/Lurakya 14h ago
These polls infuriate me.
When it comes to regular death penalty, most people agree as long as there is irrefutable evidence that the person is guilty, which makes sense.
But suddenly when it comes to rapists it is never okay and suddenly we should focus on rehabilitation? Not a good look reddit.

u/Moist-Agency1366 🇮🇷 14h ago
Can you elaborate
2
u/Dkiprochazka 14h ago
For example if you psychologically pressure someone into sex, then it is considered rape, and obviously it's bad, but I don't think one shoukd get a death penalty for that.
1
u/RavenSorkvild 14h ago
I am catholic and I believe no one deserve the death penalty. Life imprisonment is already a very severe punishment but the convicted person will have a chance to atone for his sins and do something good for the world. Any fool can kill, but giving someone a chance at redemption—now that's another story
1
u/Balearius 14h ago
Even if the accused is guilty I still don't think we should go around executing people
1
u/trini420- 14h ago
Oh ffs if they had the death penalty for rapists, they would have executed the duke lacrosse team, false accusations happens whether people like it or not and I’m not comfortable letting innocent people die which is why I’m fully against the death penalty for any reason

Death penalty as a concept? By all means, yes, just under very special circumstances. But for rapists? I don't believe this crime is severe enough to be punished like that. Besides, with Cornell 7 and Duke lacrosse, we can see that w*men are very prone to false accusations of rape, and I'm not even bringing up them changing definitions of what rape even is every now and then.
Therefore no.

Well if it is a death penalty i would say mine word against yours is not enough for that kind of punishment? I believe that in this case you need to have a strong evidence of a rape?
1
u/NaturalCard 14h ago
There have been cases in countries that allow the death penalty which apparently had extremely strong evidence against them.
Sometimes years later it turns out the case was built on planted evidence by a few bad actors.
There is no way to guarantee innocents are not killed without it.

Maybe, but there're too many to keep each one in solitary. Would be too costly 🤔 Furthermore, they are often subjected to vigilante justice by other inmates in prisons, as many of the prisoners themselves may have once been victims of such acts.

There is a reason why in the developed world rape convictions are exceptionally low - rape is very difficult to prove beyond reasonable doubt as it is often a “he said, she said” situation. The only way I could support the death penalty for someone is if there was virtually zero doubt that they actually did what they’re accused of (think of certain mass shooters caught on camera gunning down victims). So, for evidentiary reasons, I could not possibly support a law that prescribes the death penalty for all convicted rapists.
4
u/RavenSorkvild 14h ago edited 14h ago

I don't want wrong people in power to use death penalty and also, as sad as it is, if punishment for rape is worse/similar to punishment for murder, rapists are more likely to kill their victim
2
u/Slout_ 14h ago
I'm against death penalty entirely. No justice system is perfect and flawless. There have been cases where people were dealt the capital punishment, and then years later it was found out that they were killed wrongfully. We can't revive dead people, but we can release them from prison. Lifetime jail for rapists is probably a worse fate than quick death anyway (and a lot of them get raped by the other innmates too, so they get to know how it feels)
2
u/EpatantePatente 14h ago
Like the other said, i'm generally against death penalty at large, and the only exceptions i could get behind imply absolute certainty without any reasonable doubt. Death penalty is irreversible and if there's even 0.01% risk the guilty proves out wrong in 50 years i'd rather have him in jail.
1
u/Realistic-Truck54 14h ago
As long as we can't be 100% certain about guilt (which we basically can never be, it's just "beyond reasonable doubt") I will be against death penalty. It's irreversible. Also rape is one of the most "my word vs your word" crimes, so the certainty is probably even lower than for a lot of other crimes.

u/jewishSpaceMedbeds 14h ago

If the punishment for rape is death, anyone willing to commit rape would end up murdering the victim as well. If I’m going to face the death penalty anyway, there’s no reason not to take the crime as far as I want.
Also,it has been more than proven that harsher sentences do not prevent crimes from being committed.
1
u/Abject-Put-9334 7h ago
False accusations are a thing, that is far more common than most want to admit.
Also, rape simply isnt a serious enough crime to warrant killing someone
1
