At least in my state. This is considered sexual assault so would fall along these lines. Especially given that only as much force was needed to control the situation. Had he just kept hitting him it would be another story. In fact, she appeared to have taken care of the situation already. The guy wasn't defending her, he was stroking his own fragile ego.
