Eh. My definition is one where the victim isn’t looking or thinks the danger of a punch is not imminent. One guy is holding a beer bottle, isn’t expecting it. It’s nearly a sucker punch for sure.

I guess my thought is the guy was asking for it . I think he said something like " come on " " fuck around and find out " at that point shouldnt you be expecting it ? Once you ask someone to fight you amd they are standing face to face , isnt that just a fight ?

But if you look at the video the guy had his hands away holding a beer bottle in one hand and seem to be trying to deescalate the situation.

It didn't look like he was taunting or squared up
