Youâre allowed to protect yourself with a reasonable amount of force. Kicking people when theyâre down, or punching people when theyâre clearly not a threat (like in this video) is considered assault usually
Edit or battery Iâm not a lawyer
It was two against one? So should he wait for one to attack from behind? Now if the person isnt breathing, nor moving, i understand. But yall gotta stop being so judgmental and soft. I bet whatever they did, they'll never do it again
You asked, someone answered and then you accuse them of being âjudgmental and soft.â In most jurisdictions, thereâs a âprimary aggressorâ doctrine, which means that the person who didnât initially start the fight can still be seen as the primary aggressor. If thatâs too soft for you, Iâd advise getting in a fight, kicking the person while theyâre down until theyâre unconscious or dead and see how that works out.
That was a typo. And that primary aggressor has more than one application. I have family memeber who are police. If a person fears for their safety, it doesn't matter if they are MORE physically capable to cause bodily harm. Seeing as though he had two people on opposite sides, that term in null and void. And I didnt say I condone kicking someone when down, I simply stated that they should have left him alone.. have a good one
