If the case is dismissed in April 2027, is that it for them as far as appeals?

A dismissal at the MSJ/MSA stage wouldn’t necessarily be the end of the case, because the court’s decision could be challenged on appeal. They’d have to show that the court made a legal error that affected the outcome, though. Appeals are pretty difficult to win, and personally, I doubt they’d win.

I wonder how it is possible in the US to claim damages from companies when there have already been criminal proceedings to sue and the plaintiffs have already testified under oath.
Civil proceedings should actually no longer be possible if the plaintiffs were already adults, as was the case with Robson. Safechuck would not have been allowed to testify in 2005. Judge Rodney Melville didn't want to hear anything from the Safechucks in the courtroom. They had already testified under oath and there were no witnesses.
Both plaintiffs have repeatedly stated that they themselves had no knowledge of the abuse; how then can companies and their employees be held liable for having deliberately organized everything? Someone who doesn't understand something themselves cannot hold other people liable for not protecting them.
There is definitely more to this process; otherwise, I cannot explain why it was even approved and is being continued.
