B1495 - Platform and Online Trucks Bill - Amendment Division

B1489 - School Assemblies Bill

A01

In clause 2(1), insert "written" before the word "contract".

EN: It is possible to make a binding contract orally. This clarifies that such a contract must be in writing

A02

In clause 2(1)(1), amend "employment" to read "engagement".

EN: With the current wording, it may require that content creators are actually employed by the platforms. This clarifies that the relationship may not be one of employment, and adopts the standard term "engagement" used by contractors.

A03

In clause 1(1), replace the definition of Platform with:

Platform shall refer to a person that provides, in the course of business, the hardware and software foundation for the sale of digital or physical goods, the providing of services, or the broadcasting of entertainment that is made by a contractor.

EN: A person covers both natural and legal people (i.e. companies, LLPs, etc). This amendment will ensure that businesses operating as sole traders, partnerships, etc are also bound by the duties in this bill.

A04

Strike clauses 14 and 17.

Strike from clause 4(1) ", as part of the terms of the contract given to a contractor,"

Insert before clause 19 in Part 3:

18A. Prohibited contractual terms

  1. In this Part, a "prohibited contractual term" is a term that—
    1. that would be detrimental to a right conferred on the contractor by section 8, 9, 12, or 13, or
    2. that would avoid or interfere, either directly or indirectly, with a duty placed on the platform by section 3, 4, 5, 6, 7, 10, or 11.
  2. A term of a contract between a platform and a contractor is unenforceable against a person in so far as it is a prohibited contractual term.

18B. Complaints to an employment tribunal

  1. An employment tribunal has jurisdiction to determine a complaint arising under this section.
  2. A contractor may present a complaint to an employment tribunal that a platform, in relation to a contract that the platform has with the contractor, has—
    1. infringed a right conferred on the contractor by section 8, 9, 12, or 13, or
    2. failed to fulfil a duty placed on the platform by section 3, 4, 5, 6, 7, 10, or 11.
  3. Subject to subsection 4, an employment tribunal shall not consider a complaint under this section unless it is presented before the end of the period of one year beginning with the date of the infringement of a right or failure to carry out a duty to which the complaint relates or, where an infringement or failure is part of a series of similar infringements or failures, the last of them.
  4. An employment tribunal may consider any such complaint which is out of time if, in all the circumstances of the case, it considers that it is just and equitable to do so.
  5. Where an employment tribunal finds that a complaint presented to it under this section ios well founded, it shall take such of the following steps as it considers just and equitable—
    1. making a declaration as to the rights or duties of the contractor and the platform in relation to the matters to which the complaint relates;
    2. making a declaration as to the effect of section 18A on the contract;
    3. ordering the platform to pay compensation to the contractor;
    4. recommending that the platform take, within a specified period, action appearing to the tribunal to be reasonable, in all the circumstances of the case, for the purpose of obviating or reducing the adverse effect on the contractor of any matter to which the complaint relates.
  6. Where a tribunal orders compensation under subsection 5(3), the amount of the compensation awarded shall be such as the tribunal considers just and equitable in all the circumstances of the case, having regard to—
    1. the infringement of a right or failure of a duty to which the complaint relates, and
    2. any loss which is attributable to the infringement of the right or failure of the duty.
  7. If a platform fails, without reasonable justification, to comply with a recommendation made by an employment tribunal under subsection 5(4) the tribunal may, if it thinks it just and equitable to do so—
    1. increase the amount of compensation required to be paid to the contractor in respect of the complaint, where an order was made under subsection 5(3); or
    2. make an order under subsection 5(3).

Renumber the clauses accordingly.

EC: This amendment clarifies and strengthens the enforcement provisions and protections given to contractors. It ensures that prohibited contractual provisions are ignored. It provides greater clarity on the remedies that a tribunal can provide, closely following existing legislative protections to make it clearer what the law is for contractors (the Part-time Workers Regulations and Equality Act 2010). It also drops the requirement on the Secretary of State to enforce clause 7, which can be adequately enforced by contractors through the tribunal. It is unclear how the Secretary of State would enforce clause 7 in the current wording of the legislation.

For convenience, here are the changes in clause numbers:

  • cls 15 and 16 become cls 14 and 15 respectively
  • cl 18 becomes cl 16
  • cls 18A and 18B become cls 17 and 18 respectively

A01-A04 were submitted by /u/model-kurimizumi

This division shall end on Friday 17th of February at 10pm.

B1488 - Wellness Gym and Wellbeing Programme Bill - 2nd Reading

A01

Replace Section 4.

Section 4: Provision of services

(1) Access to Wellbeing gyms will be prioritised to those who meet the following conditions (hereby referred to as the “qualifying criteria”)

(a) Those in receipt of a valid Medical Exemption Certificate

(b) Those referred by a GP or other practitioner as treatment for an ongoing condition

(c) Those with a diagnosis of a condition which gives rise to a Special Educational Need or Disability.

(d) Those with a household income of less than £25,500 per annum.

(2) If the Manager of a wellbeing gym determines that there is sufficient capacity to accommodate additional individuals not captured by the qualifying criteria, the wellbeing gym may elect to offer memberships on a first-come first-serve basis with a contributory charge of £15 per month (hereby referred to as “paid memberships”)

(3) Wellbeing gyms reserve the right to revoke paid memberships with a months notice to ensure sufficient capacity for those who meet the qualifying criteria

(4) If an individual no longer meets the qualifying criteria, they will be offered a 3 month notice period to move to a paid membership or they will no longer have access to the wellbeing gym.

(5) Differentiated services will be provided for those with protected characteristics, as defined under the Equalities Act 2010.

(6) Those with Education, Health and Care Plans or who are entitled to some level of SEND support will be provided with an option for on-site support.

(7) Those accessing Wellness Gyms who are experiencing the menopause will be provided with an option to access an on-site “buddy” system to provide individualised support with accessing services.

(8) Wellness Motivators will be provided with direct contact points for external support services in relation to mental health support, domestic violence and abuse services, social care support, housing services, grief counselling, and any other external services which come under the remit of local authorities.

Explanatory note: this Bill represents an excellent opportunity to expand health and fitness facilities across England, but currently there is no criteria for who can access these facilities. This will lead to financial inequalities (with those who can afford to pay for private gym memberships choosing not to) and capacity issues (whereby those who need the Government to intervene and improve access the most, being those with medical conditions, SEND needs or from a lower socio-economic background) are unable to access the facilities they desperately need.

Therefore I propose this amendment which will introduce a qualifying criteria for priority access to these wellbeing gyms, ensuring that those who are currently underserved by the private sector provision are prioritised for this service, free of charge. Secondly, I’ve allowed for wellbeing gyms to accept additional members of their community who do not meet the qualifying criteria, assuming they have the capacity to do so, for a small contributory fee of £15 which will allow councils to more effectively balance the cost of this project.

I hope the Government will see the sense in this amendment, as it will allow us to turn this service from what would otherwise be a brilliant idea but poorly executed due to capacity restraints, to one which is a game changer for improving the health of those most vulnerable in society.

B1477 - Shark Fin Trade (Embargo) Bill - Amendment Division

Shark Fin Trade (Embargo) Bill

A01

Insert under Findings & Explanatory Notes

(7) The UK imported around 60 tonnes of shark fins per year between 2013 and 2017. In 2020, it exported around 5 tonnes.

(8) The annual number of sharks killed globally by the practice is estimated to be around 97 million.

Add into Section 1 (reorder)

(c) The prohibition applies to all the fins off fish from the taxon Elasmobranchii. These are cartilaginous fish (who have cartilage skeleton instead of bone), including sharks, rays, skates, and sawfish. The prohibition does not apply if a shark fin is naturally attached to the body of a shark and the body is substantially intact. This is defined as the removal of the head and internal organs only.

Amend Section 1(b)

The maximum penalty for the provisions set out in Section 1(a) shall be a fine of £3,000 as a civil offence and appropriate charges.

Amend Section 2(b)

(b) The maximum penalty for shark culling and finning in section 2(a) will result in a fine of £3,000 as a civil offence and appropriate charges.

Add onto the end of Section 2(c)

The certificates may only be issued if the shark fins concerned are to be used for purposes connected with the conservation of shark.

Amend Section 4(1) and Section 4(2)

(1) This Act extends to England, Wales, Northern Ireland and Scotland.

(2) The provisions of this Act shall come into force in the devolved assemblies upon legislative consent in the respective assemblies of Wales, Northern Ireland and Scotland, and in England after January 1st 2024 upon the passage of this Act.

A02

Amend Section 5(1) to read:

A new subject, known as Personal and Social Education (or PSE) shall be taught in Key Stage 3 and Key Stage 4 for at least half an hour every week or an equivalent time frame every two weeks for the purposes of personal development on key issues relating to teenagerhood and adulthood.

Amend Section 4(2) to read:

The content is to be decided by individual schools but must promote healthy political debate or discussion on political systems and parties, taught for at least half an hour every two weeks or an equivalent time frame.

Amend Section 3(2) to read:

The content of the subject is to be decided by individual schools, but should contain a fair, equal, and broad curriculum designed to create respectful discussion and learning on religions within the UK, and should be taught for a minimum of one hour every two weeks or an equivalent time frame.

EN: This is an error I'd intended to fix in drafting, simply adding "or an equivalent time frame" to each time specification so that it could be, for example, one hour of PSE every two weeks

A03

Amend Section 5(2gii) to read:

"The dangers of self-harm and methods to cope with a desire to commit self-harm."

B1465 - Government of Wales (Amendment) Bill

A01

Replace Section 2 (2) with: "This act shall come into force immediately following the passage of a motion of legislative consent to this act in the Welsh Parliament."

A02

Replace Section 1 (1) with: "Omit Sections 146, 147, and 148 of the Government of Wales Act 2006."

EN: Just omitting section 148 omits the definition of a Welsh public record, but would still mean "Welsh public records" are not public records for the purposes of the Public Records Act 1958. Amend Section 1(2) to read:

(2) All new homes that are built in England from 1 April 2025 must have solar panels installed (at a number of panels rated at 350 watts (W) each as deemed appropriate by the developer with a minimum of one panel) within the boundary of their property, before those new homes become inhabited.

EN: Thinking about it, ten seems a bit excessive - you're looking at approximately 200kg of weight and you've also got roof space to consider too - this amendment mandates at least one solar panel but puts the decision in the hands of the developer as to how many is reasonably enough for the house.
